(a) The Dairy Produce Act 1986 was amended by section 3 only of the Statute Law (Miscellaneous Provisions) Act (No. 2) 1986, subsection 2(4) of which provides as follows:
(4) The amendment of paragraph 36(3)(d) of the Dairy Produce Act 1986 made by this Act shall be deemed to have come into operation on 1 July 1986.
(b) The Dairy Produce Act 1986 was amended by section 3 only of the Statute Law (Miscellaneous Provisions) Act 1987, subsection 2(1) of which provides as follows:
(1) Subject to this section, this Act shall come into operation on the day on which it receives the Royal Assent.
(c) The Dairy Produce Act 1986 was amended by section 3 only of the Primary Industries (Recovery of Levy Collection Expenses) Act 1988, subsection 2(1) of which provides as follows:
(1) Subject to sections (2), (3) and (4), this Act commences on the day on which it receives the Royal Assent.
(d) The Dairy Produce Act 1986 was amended by section 3 only of the Primary Industries and Energy Legislation Amendment Act 1988, subsection 2(1) of which provides as follows:
(1) Subject to this section, this Act commences on the day on which it receives the Royal Assent.
(e) The Dairy Produce Act 1986 was amended by section 53 only of the Rural Industries Research Amendment Act 1988, subsection 2(1) of which provides as follows:
(1) Subject to this section, this Act commences on the day on which it receives the Royal Assent.
(f) The Dairy Produce Act 1986 was amended by section 3 only of the Primary Industries and Energy Legislation Amendment Act (No. 2) 1989, subsection 2(1) of which provides as follows:
(1) Subject to this section, this Act commences on the day on which it receives the Royal Assent.
(g) Section 2 of the Dairy Produce Amendment Act 1996 provides as follows:
2 This Act is taken to have commenced on 1 July 1995, immediately after the commencement of the Dairy Produce Amendment Act 1995.
(h) The Dairy Produce Act 1986 was amended by Schedule 4 (item 57) only of the Statute Law Revision Act 1996, subsection 2(1) of which provides as follows:
(1) Subject to subsections (2) and (3), this Act commences on the day on which it receives the Royal Assent.
(i) The Dairy Produce Act 1986 was amended by Schedule 2 (items 662-695) only of the Audit (Transitional and Miscellaneous) Amendment Act 1997 subsection 2(2) of which provides as follows:
(2) Schedules 1, 2 and 4 commence on the same day as the Financial Management and Accountability Act 1997.
(j) The Dairy Produce Act 1986 was amended by Schedule 11 only of the Primary Industries Levies and Charges (Consequential Amendments) Act 1999, subsection 2(1) of which provides as follows:
(1) Subject to this section, this Act commences on the commencement of section 1 of the Primary Industries (Excise) Levies Act 1999.
(k) The Dairy Produce Act 1986 was amended by Schedule 1 (items 359 and 360) only of the Public Employment (Consequential and Transitional) Amendment Act 1999, subsections 2(1) and (2) of which provide as follows:
(1) In this Act, commencing time means the time when the Public Service Act 1999 commences.
(2) Subject to this section, this Act commences at the commencing time.
(l) The Dairy Produce Act 1986 was amended by Schedule 10 (items 71-75) only of the Corporate Law Economic Reform Program Act 1999, subsection 2(2)(c) of which provides as follows:
(2) The following provisions commence on a day or days to be fixed by Proclamation:
(c) the items in Schedules 10, 11 and 12.
(m) The Dairy Produce Act 1986 was amended by Schedule 3 (item 166) only of the Corporations (Repeals, Consequentials and Transitionals) Act 2001, subsection 2(3) of which provides as follows:
(3) Subject to subsections (4) to (10), Schedule 3 commences, or is taken to have commenced, at the same time as the Corporations Act 2001.
(n) Subsection 2(1) (item 10) of the Agriculture, Fisheries and Forestry Legislation Amendment Act (No. 1) 2003 provides as follows:
(1) Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, on the day or at the time specified in column 2 of the table.

Dairy Industry Adjustment Act 2000 (No. 22, 2000)
Schedule 1
18 Transitional--membership of the DAA
(1) This item applies to the committee known as the Dairy Adjustment Panel that:
(a) was established under the executive power of the Commonwealth; and
(b) was in existence immediately before the commencement of this item; and
(c) consisted of the following members:
(i) a Chair;
(ii) 2 industry members;
(iii) a government member;
(iv) one other member;
where:
(d) a person was not appointed as the Chair, or as the member referred to in subparagraph (c)(iv), unless it appeared to the Minister that the person had knowledge of, or experience in, one or more of the following fields:
(i) business management;
(ii) finance;
(iii) legal practice;
(iv) actuarial practice; and
(e) a person was not appointed as an industry member unless it appeared to the Minister that the person had knowledge of, or experience in, the production of dairy produce; and
(f) a person was not appointed as the government member unless it appeared to the Minister that the person had knowledge of, or experience in, either or both of the following fields:
(i) the formulation of government policy;
(ii) public administration.
(2) The Dairy Produce Act 1986 has effect as if:
(a) the Minister had, by instrument (the notional instrument of appointment), appointed the Chair of the Dairy Adjustment Panel to be the Chair of the Dairy Adjustment Authority immediately after the commencement of this item; and
(b) the period of appointment specified in the notional instrument of appointment were the period:
(i) beginning immediately after the commencement of this item; and
(ii) ending at the end of the period specified in the Chair's instrument of appointment to the Dairy Adjustment Panel.
(3) The Dairy Produce Act 1986 has effect as if:
(a) the Minister had, by instrument (the notional instrument of appointment), appointed each industry member of the Dairy Adjustment Panel to be an industry member of the Dairy Adjustment Authority immediately after the commencement of this item; and
(b) the period of appointment specified in the notional instrument of appointment were the period:
(i) beginning immediately after the commencement of this item; and
(ii) ending at the end of the period specified in the member's instrument of appointment to the Dairy Adjustment Panel.
(4) The Dairy Produce Act 1986 has effect as if:
(a) the Minister had, by instrument (the notional instrument of appointment), appointed the government member of the Dairy Adjustment Panel to be the government member of the Dairy Adjustment Authority immediately after the commencement of this item; and
(b) the period of appointment specified in the notional instrument of appointment were the period:
(i) beginning immediately after the commencement of this item; and
(ii) ending at the end of the period specified in the member's instrument of appointment to the Dairy Adjustment Panel.
(5) The Dairy Produce Act 1986 has effect as if:
(a) the Minister had, by instrument (the notional instrument of appointment), appointed the member of the Dairy Adjustment Panel mentioned in subparagraph (1)(c)(iv) of this item to be the member of the Dairy Adjustment Authority mentioned in paragraph 58(1)(d) of Schedule 2 to the Dairy Produce Act 1986, and had done so immediately after the commencement of this item; and
(b) the period of appointment specified in the notional instrument of appointment were the period:
(i) beginning immediately after the commencement of this item; and
(ii) ending at the end of the period specified in the member's instrument of appointment to the Dairy Adjustment Panel.

Schedule 2
418 Transitional--pre‑commencement offences
(1) Despite the amendment or repeal of a provision by this Schedule, that provision continues to apply, after the commencement of this item, in relation to:
(a) an offence committed before the commencement of this item; or
(b) proceedings for an offence alleged to have been committed before the commencement of this item; or
(c) any matter connected with, or arising out of, such proceedings;
as if the amendment or repeal had not been made.
(2) Subitem (1) does not limit the operation of section 8 of the Acts Interpretation Act 1901.
419 Transitional--pre‑commencement notices
If:
(a) a provision in force immediately before the commencement of this item required that a notice set out the effect of one or more other provisions; and
(b) any or all of those other provisions are repealed by this Schedule; and
(c) the first‑mentioned provision is amended by this Schedule;
the amendment of the first‑mentioned provision by this Schedule does not affect the validity of such a notice that was given before the commencement of this item.

(1) Each amendment made by this Act applies to acts and omissions that take place after the amendment commences.
(2) For the purposes of this section, if an act or omission is alleged to have taken place between 2 dates, one before and one on or after the day on which a particular amendment commences, the act or omission is alleged to have taken place before the amendment commences.

127 Dairy produce
A product that is dairy produce, immediately before the commencement of this item, under paragraph (c) of the definition of dairy produce in subsection 3(1) of the Dairy Produce Act 1986 is taken, after the commencement of this item, to continue to be dairy produce under that paragraph.
128 Continuation of secrecy obligations
Section 119 of the Dairy Produce Act 1986 as in force before the commencement of this item continues to apply after the commencement of this item to a person who, immediately before the commencement of this item, was a person to whom that section applied as if the amendments to that section made by this Schedule had not been made.
129 Final annual reports
(1) For the final reporting period, the directors of Dairy Australia Limited must, in relation to the Australian Dairy Corporation and the Dairy Research and Development Corporation, prepare the report referred to in section 9 of the Commonwealth Authorities and Companies Act 1997. The report may include such other matters as the directors consider appropriate.
(2) For the purposes of this item, the final reporting period is to be treated as a financial year.
(3) In this item:
final reporting period means the period that:
(a) started on 1 July 2002; and
(b) ends at the commencement of this item.

3 Applying provisions referring to the Dairy Adjustment Authority after it ceases to exist
(1) This item applies to a reference to the Dairy Adjustment Authority, to the extent that the reference concerns a power or function of that body, in any of the following:
(a) a provision of Schedule 2 to the Dairy Produce Act 1986 or a regulation made for the purposes of that Schedule;
(b) a provision of the DEP scheme, the DSAP scheme or the SDA scheme (all within the meaning of that Schedule);
(c) a provision of another Act (other than this Act) or a regulation made for the purposes of another Act.
(2) If, because of subclause 55(3) of Schedule 2 to the Dairy Produce Act 1986, the Dairy Adjustment Authority has ceased to exist after a specified day, then, for the purposes of the provision referred to in subitem (1) after that day, the reference is taken to be a reference to a function or power performed or exercised by the Secretary of the Department.
(3) To avoid doubt, if, because of subclause 55(3) of Schedule 2 to the Dairy Produce Act 1986, the Dairy Adjustment Authority has ceased to exist after a specified day:
(a) a reference in subclause 73(1) of Schedule 2 to the Dairy Produce Act 1986 to the DAA's functions and powers; or
(b) a reference in subparagraph 79(i)(ii) of that Schedule to the functions, or the powers, of the DAA;
is taken, after that day, to be a reference to the functions and the powers, or the functions or the powers, of the Secretary of the Department to the extent that the Dairy Adjustment Authority was, before that day, capable of performing or exercising the power or function.
