Note 1

The Extradition Act 1988 as shown in this compilation comprises Act
No. 4, 1988 amended as indicated in the Tables below.

Note 2

Nuclear Terrorism Legislation Amendment Act 2012 (No. 3, 2012)

The following amendment commences on proclamation or 1 month after the day on which the International Convention for the Suppression of Acts of Nuclear Terrorism, done at New York on 13 April 2005, comes into force for Australia. However, the amendment may not commence, see subsection 2(1) (items 2 and 3):

Schedule 1

8  Section 5 (at the end of paragraph (a) of the definition of political offence)

Add:

                        or (x)  Article 2 of the International Convention for the Suppression of Acts of Nuclear Terrorism, done at New York on 13 April 2005;

As at 14 March 2012 the amendment is not incorporated in this compilation.

Application, saving or transitional provisions

Extradition Amendment Act 1990 (No. 76, 1990)

4  Modification of Act in relation to certain countries

             (2)  Regulations to which this subsection applies are to be regarded as if:

                     (a)  subsections 11 (1A), (1B), (1C) and (3) of the Principal Act, as amended by this Act, had been in force on the date of commencement of the regulations; and

                     (b)  the regulations had been made on that date under subsection 11 (1A).

             (3)  Subsection (2) applies to regulations made under paragraph 11 (1) (b) of the Principal Act and providing that that Act applies to a specified extradition country subject to a particular multilateral extradition treaty.

 

Crimes (Aviation) Act 1991 (No. 139, 1991)

41  Evidence: record of evidence taken at preliminary inquiries

             (1)  A document certified by the Attorney-General to be a record of evidence sent to the Attorney-General under section 37 is admissible in evidence in any of the following:

                     (a)  proceedings under section 38 or 39;

                     (b)  proceedings in respect of an offence against this Act;

                     (c)  proceedings under the Extradition Act 1988;

and, when so admitted, the evidence recorded in it is evidence in the proceedings.

Modifications

A.C.T. Self-Government (Consequential Provisions) Regulations

Section 5 (definition of magistrate)

Before "the Northern Territory" (wherever occurring) insert "the Australian Capital Territory,".

Paragraph 46(1)(b)

Omit the paragraph, substitute the following paragraph:

                   "(b)  arrange with:

                              (i)  the Chief Minister of the Australian Capital Territory; or

                             (ii)  the Administrator of the Northern Territory or the Territory of Norfolk Island;

                   for the performance, by all or any of the persons who from time to time hold office as magistrates of that Territory, of the functions of a magistrate under this Act.".
