Clean Energy (Household Assistance Amendments) Act 2011
(No. 141, 2011)
The following amendments commence on 20 March 2013:
Schedule 4
10 Subsection 5(1) (after paragraph (a) of the definition of clean energy bonus)
Insert:
(b) a payment known as a clean energy supplement or a quarterly clean energy supplement;
11 Subsection 5(1) (at the end of the definition of clean energy payment)
Add "or clean energy supplement".
Insert:
clean energy supplement means clean energy supplement payable under section 209A or 238A.
Omit "or for financial advice", substitute ", financial advice or clean energy supplement".
14 After section 209
Insert:
209A Clean energy supplement for Special Rate Disability Pension
(1) The Commonwealth is liable to pay a clean energy supplement to a person for a day if:
(a) Special Rate Disability Pension:
(i) is payable to the person for the day; or
(ii) would be payable to the person for the day apart from section 204 and paragraph 398(3)(b); and
(b) the person resides in Australia on the day; and
(c) on the day the person either:
(i) is in Australia; or
(ii) is temporarily absent from Australia and has been so for a continuous period not exceeding 13 weeks.
Note: Section 424L may affect the person's entitlement to the clean energy supplement.
(2) The daily rate of the supplement is 1/ 14 of the CES 24(4) rate under the Veterans' Entitlements Act 1986 on the day.
15 At the end of Division 2 of Part 2 of Chapter 5
Add:
238A Clean energy supplement for compensation for wholly dependent partners of deceased members
(1) The Commonwealth is liable to pay a clean energy supplement to a person for a day if:
(a) the condition in subsection (2) is met for the day; and
(b) the person is residing in Australia on the day; and
(c) on the day the person either:
(i) is in Australia; or
(ii) is temporarily absent from Australia and has been so for a continuous period not exceeding 13 weeks.
Note: Section 424L may affect the person's entitlement to the clean energy supplement.
Condition--receipt of compensation under this Division
(2) The condition is that either or both of the following apply:
(a) weekly compensation under this Division (except this section) either:
(i) is payable to the person for the day; or
(ii) would be payable to the person for the day apart from paragraph 398(3)(b);
(b) before the day the person received lump sum compensation under this Division and subsection 388(6) has not applied to the person before the day.
Rate of clean energy supplement
(3) The daily rate of the supplement is 1/ 14 of the CES 30(1) rate under the Veterans' Entitlements Act 1986 on the day.
16 After subsection 430(3)
Insert:
(3AA) In specifying intervals in a direction under subsection (1), the Commission may take account of a person's choice, notified to the Commission, to be paid clean energy supplement quarterly. This does not limit the Commission's powers under that subsection.
The following amendments commence on 1 July 2013:

18 At the end of Part 2 of Chapter 4
Add:
83A Clean energy supplement for compensation under this Part
(1) The Commonwealth is liable to pay a clean energy supplement to a person for a day if:
(a) the condition in subsection (2) is met for the day; and
(b) the person is residing in Australia on the day; and
(c) on the day the person either:
(i) is in Australia; or
(ii) is temporarily absent from Australia and has been so for a continuous period not exceeding 13 weeks.
Note: Section 424L may affect the person's entitlement to the clean energy supplement.
Condition--receipt of compensation under this Part
(2) The condition is that either or both of the following apply:
(a) weekly compensation under this Part (except this section):
(i) is payable to the person for the day; or
(ii) would be payable to the person for the day apart from paragraph 398(3)(b) (of this Act) and offsetting described in subsection 13(4) of the Military Rehabilitation and Compensation (Consequential and Transitional Provisions) Act 2004;
(b) before the day the person received lump sum compensation under this Part.
Rate of clean energy supplement
(3) The daily rate of the supplement is, subject to section 404, 1/ 14 of the CES 22(3) rate under the Veterans' Entitlements Act 1986 on the day.
Note: Section 404 provides for indexation of the daily rate for each indexation year starting on or after 1 July 2014.
19 Section 404 (heading)
Repeal the heading, substitute:
404 Indexation of amounts and rates
Repeal the subsection, substitute:
(1A) This section also applies, for indexation years commencing on and after 1 July 2014, to the daily rate mentioned in subsection 83A(3).
(2) The dollar amount or rate mentioned in the provision, for an indexation year in which the indexation factor is greater than 1, is replaced by the amount or rate worked out using the formula:

21 After subsection 404(5)
Insert:
(5A) For the purposes of replacing the dollar amount mentioned in subsection 74(1) for an indexation year starting on or after 1 July 2013, the indexation factor is reduced by the brought-forward CPI indexation amount for the year, but not below 1.
Insert:
brought-forward CPI indexation amount for an indexation year starting on or after 1 July 2013 means 0.007 less any reduction made under subsection (5A) for an earlier indexation year.
As at 14 May 2012 the amendments are not incorporated in this compilation.

36 Telephone allowance under the Military Rehabilitation and Compensation Act 2004
(1) If, immediately before the commencement of this item, telephone allowance is payable to a person under Division 4 of Part 7 of Chapter 4 of the Military Rehabilitation and Compensation Act 2004 in relation to a telephone connection, the person is taken to have given notice, in relation to that telephone connection, in accordance with subsection 222(4) of that Act (as amended by this Schedule).
(2) If, immediately before the commencement of this item, telephone allowance is payable to a person under Division 5 of Part 2 of Chapter 5 of the Military Rehabilitation and Compensation Act 2004 in relation to a telephone connection, the person is taken to have given notice, in relation to that telephone connection, in accordance with subsection 246(4) of that Act (as amended by this Schedule).

4 Waiver of earlier overpayments
If:
(a) before the commencement of this Part, an amount of compensation was paid as if the amendment made by this Part had already commenced; and
(b) that amount exceeded the amount of compensation that was payable because the amendment had not commenced; and
(c) the excess would be recoverable by the Commonwealth apart from this item;
the right to recover the excess is waived.
7 Application of amendments
The amendments made by this Part apply in relation to a claim made on or after the commencement of this Part, whether a claim for compensation for the same matter has been made before, on or after that commencement.

9 Application of items 1 to 4
The following provisions of the Military Rehabilitation and Compensation Act 2004:
(a) note 1 to subsection 89(3);

(d) section 179;
apply as if a reference in those provisions to the national minimum wage order includes a reference to:
(e) the standard federal minimum wage, to the extent that the standard federal minimum wage continues to operate as a transitional standard federal minimum wage in accordance with the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009; and
(f) special federal minimum wages, to the extent that special federal minimum wages continue to operate as a transitional special federal minimum wage in accordance with the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009; and
(g) the transitional national minimum wage order, within the meaning of the Fair Work (Transitional Provisions and Consequential Amendments) Act 2009.

214 Pharmaceutical allowance and telephone allowance under the Military Rehabilitation and Compensation Act
(1) Despite the amendments of Division 4 of Part 7 of Chapter 4, and of Division 5 of Part 2 of Chapter 5, of the Military Rehabilitation and Compensation Act 2004 made by this Schedule, those Divisions, as in force immediately before the commencement of this item, continue to apply on and after that commencement in relation to the first telephone allowance payday that falls after 20 September 2009.
(2) For the purposes of subitem (1), section 198F of the Veterans' Entitlements Act 1986, as in force immediately before the commencement of this item, applies in relation to 20 September 2009.
(3) Despite the amendments of Division 4 of Part 4 of Chapter 6 of the Military Rehabilitation and Compensation Act 2004 made by this Schedule, that Division, as in force immediately before the commencement of this item, continues to apply on and after that commencement in relation to days occurring before 20 September 2009.
(4) Despite the amendments made by items 65, 66 and 67, table items 10 and 20 in section 52-114 of the Income Tax Assessment Act 1997 (as in force immediately before the commencement of this item) continue to apply on and after that commencement in relation to payments of telephone allowance or pharmaceutical allowance made before, on or after that commencement.
(5) Sections 388, 398, 401, 402 and 403 of the Military Rehabilitation and Compensation Act 2004 apply on and after the commencement of this item as if a reference in those sections to MRCA supplement included a reference to telephone allowance.
(6) Despite the amendment made by item 98, subsection 1061JD(2) of the Social Security Act 1991 (as in force immediately before the commencement of that item) continues to apply on and after that commencement in relation to payments of pharmaceutical allowance made under the Military Rehabilitation and Compensation Act 2004 before, on or after that commencement.
(7) Despite the amendment made by item 160, paragraph 5H(8)(zt) of the Veterans' Entitlements Act 1986 (as in force immediately before the commencement of that item) continues to apply on and after that commencement in relation to a payment mentioned in that paragraph made before, on or after that commencement.
