NATIONAL MEASUREMENT ACT 1960 - SECT 18GC

Supplying measuring instruments not of an approved pattern

Offence requiring fault element

             (1)  A person commits an offence if:

                     (a)  the person sells or otherwise supplies a measuring instrument; and

                     (b)  the measuring instrument is sold or otherwise supplied for use for trade; and

                     (c)  the measuring instrument is not of an approved pattern.

Penalty:  200 penalty units.

Strict liability offence

             (2)  A person commits an offence if:

                     (a)  the person sells or otherwise supplies a measuring instrument; and

                     (b)  the measuring instrument is sold or otherwise supplied for use for trade; and

                     (c)  the measuring instrument is not of an approved pattern.

Penalty:  40 penalty units.

             (3)  Subsection (2) is an offence of strict liability.
