DIRECTOR OF PUBLIC PROSECUTIONS ACT 1990 - NOTES

Dictionary

Note 1     The Legislation Act contains definitions and other provisions relevant to this Act.

Note 2     For example, the Legislation Act, dict, pt 1, defines the following terms:

              •     bankrupt or personally insolvent

              •     chief police officer

              •     director-general (see s 163)

              •     exercise

              •     function

              •     judge

              •     legal practitioner

              •     magistrate

              •     Magistrates Court

              •     notifiable instrument (see s 10)

"Commonwealth Act" means the Director of Public Prosecutions Act 1983 (Cwlth).

"Commonwealth director" means the Director of Public Prosecutions appointed under the Commonwealth Act.

"director" means the Director of Public Prosecutions appointed under section 22 (1).

"general proceedings" means a prosecution, proceedings or appeal referred to in section 6 (1) (a), (b), (c), (e), (f) or (g).

"member of the staff", of the office, means—

        (a)     a member of the staff mentioned in section 30 (Staff); or

        (b)     a person engaged under section 31 (Consultants etc); or

        (c)     a person whose services are made available to the director in accordance with section 32 (Other staffing arrangements).

"office" means the Office of the Director of Public Prosecutions established by section 4 (1).

"Territory authority" includes a person—

        (a)     who holds an office or position established by or under an Act; or

        (b)     who holds an appointment made under an Act.

Editorial changes

The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication. Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.

This republication does not include amendments made under part 11.3 (see endnote 1).
