ELECTORAL ACT 1992 - SECT 22

Appointment

    (1)     The Executive may appoint a person to be the Electoral Commissioner.

Note     For the making of appointments (including acting appointments), see Legislation Act 2001 , pt 19.3.

    (2)     Before a person is appointed as the commissioner, the Minister shall consult—

        (a)     the leader of each political party represented in the Legislative Assembly; and

        (b)     all members of the Legislative Assembly who are not also members of such a party;

about the proposed appointment.

    (3)      An appointment under subsection (1) is a disallowable instrument.

Note      A disallowable instrument must be notified, and presented to the Legislative Assembly, under the Legislation Act 2001 .
