Regulation-making power SCHEDULE 1 DICTIONARY ENDNOTES EXHIBITION PARK CORPORATION ACT 1976 - LONG TITLE An Act to establish an Exhibition Park Corporation EXHIBITION PARK CORPORATION ACT 1976 - SECT 1 Name of Act This Act is the Exhibition Park Corporation Act 1976. EXHIBITION PARK CORPORATION ACT 1976 - SECT 2 Dictionary The dictionary at the end of this Act is part of this Act. Note 1 The dictionary at the end of this Act defines certain terms used in this Act. Note 2 A definition in the dictionary applies to the entire Act unless the definition, or another provision of the Act, provides otherwise or the contrary intention otherwise appears (see Legislation Act, s 155 and s 156 (1)). EXHIBITION PARK CORPORATION ACT 1976 - SECT 3 Notes A note included in this Act is explanatory and is not part of this Act. Note See the Legislation Act, s 127 (1), (4) and (5) for the legal status of notes. Note for pt 2 The governance of territory authorities, including the corporation, is regulated by the Financial Management Act 1996 (the FMA), pt 9 as well as the Act that establishes them. The FMA, pt 9 deals, for example, with the corporate status of territory authorities and their powers, the make-up of governing boards, the responsibilities of the governing board and board members, how governing board positions can be ended, meetings of governing boards and conflicts of interest. EXHIBITION PARK CORPORATION ACT 1976 - SECT 4 Establishment of corporation The Exhibition Park Corporation (the corporation) is established. EXHIBITION PARK CORPORATION ACT 1976 - SECT 5 Functions of corporation The corporation has the following functions: (a) managing the national exhibition centre; (b) conducting, at the national exhibition centre, exhibitions, conventions and shows and sporting, recreational and cultural activities; (c) conducting, at the national exhibition centre, other activities that the Minister approves; (d) providing, at the national exhibition centre, buildings, structures, arenas and facilities, whether permanent or temporary, necessary for, or incidental to, the conduct of the exhibitions, shows and activities mentioned in paragraph (b) or (c); (e) conducting, on land held by the corporation under lease, the activities or undertakings authorised by the lease that the corporation considers appropriate; (f) exercising any other function given to the corporation under this Act or any other territory law. Examples of activities that may be conducted under par (e) 1 hosting sales (whether retail or wholesale) and markets 2 providing catering for functions, exhibitions, shows and other events Note 1 An example is part of the Act, is not exhaustive and may extend, but does not limit, the meaning of the provision in which it appears (see Legislation Act, s 126 and s 132). Note 2 A provision of a law that gives a function to an entity also gives the entity the powers necessary and convenient to exercise the function (see Legislation Act, s 196). EXHIBITION PARK CORPORATION ACT 1976 - SECT 6 Exercise of corporation's functions (1) In this section: "corporation land" means the national exhibition centre or land held by the corporation under lease. (2) In exercising its functions, the corporation may do any of the following: (a) hold land under lease; (b) assign and surrender leases; (c) grant subleases; (d) acquire, hold and dispose of personal property; (e) enter into contracts, other than contracts of employment; (f) grant licences to people to use corporation land for purposes for which the corporation is authorised to use the land; (g) charge for admission to corporation land; (h) grant, subject to any charges and other terms and conditions the corporation considers appropriate, rights to televise, broadcast, film or record activities conducted on or in relation to corporation land; (i) charge for the use of facilities and services provided by the corporation on or in relation to corporation land; (j) advertise and promote activities conducted on or in relation to corporation land; (k) give prizes and awards to people in relation to activities conducted on or in relation to corporation land. (3) Subsection (2) does not limit how the corporation may exercise its functions. (4) However, the corporation must not do any of the following without the Minister's written approval: (a) hold land under a lease other than a lease granted by the Commonwealth; (b) erect buildings (other than temporary buildings) on corporation land; (c) enter into a contract involving the payment or receipt of a total amount larger than $100 000; (d) carry out, or join in carrying out, works on land other than corporation land; (e) assign or mortgage a lease; (f) grant a sublease for a term of longer than 1 year. EXHIBITION PARK CORPORATION ACT 1976 - SECT 7 Sufficient revenue policy The corporation must follow a financial policy directed towards securing revenue sufficient to meet all its expenditure properly chargeable against revenue, unless the Minister otherwise directs in writing. EXHIBITION PARK CORPORATION ACT 1976 - SECT 8 Establishment of governing board The corporation has a governing board. Note An appointment of a governing board member is an appointment under this section (see Financial Management Act 1996, s 78 (5) (b)). EXHIBITION PARK CORPORATION ACT 1976 - SECT 9 Governing board members The governing board has at least 3, but not more than 5, members. Note 1 A chair and deputy chair of the governing board must be appointed under the Financial Management Act 1996, s 79. Note 2 The chief executive officer of the corporation is a member of the governing board (see Financial Management Act 1996, s 80 (4)). EXHIBITION PARK CORPORATION ACT 1976 - SECT 10 Staff (1) The corporation may make arrangements with the director-general for the use of the services of public servants in the administrative unit under the director-general's control. Note The director-general is the director-general of the administrative unit responsible for this section (see Legislation Act, dict, pt 1, def director-general). (2) The Public Sector Management Act 1994 applies in relation to the management by the corporation of public servants who are the subject of an arrangement under subsection (1). EXHIBITION PARK CORPORATION ACT 1976 - SECT 11 Application of corporation money The money of the corporation must be applied only-- (a) in payment of the costs, expenses or other obligations of the corporation under this Act; or (b) in payment of remuneration and allowances payable to anyone appointed under this Act. EXHIBITION PARK CORPORATION ACT 1976 - SECT 12 Profits of corporation (1) For this Act, the profits of the corporation for a financial year are the amount (if any) remaining after deducting from the revenue received or receivable in relation to the year in relation to the operations of the corporation the expenditure, and provision for expenditure, properly chargeable against that revenue. (2) The profits of the corporation for a financial year must be applied in the way the Minister decides. (3) In making a decision under subsection (2), the Minister must have regard to any advice given to the Minister by the corporation in relation to its financial affairs. EXHIBITION PARK CORPORATION ACT 1976 - SECT 13 Power to make by-laws (1) The corporation may, with the Minister's approval, make by-laws for this Act in relation to the management and control of the national exhibition centre. Note By-laws must be notified, and presented to the Legislative Assembly, under the Legislation Act. (2) The by-laws may make provision in relation to-- (a) the regulation or prevention of the possession, supply and consumption of liquor at the national exhibition centre; and (b) the regulation of admission of people to, the removal of people from, and the conduct of people at, the national exhibition centre; and (c) the regulation of traffic at the national exhibition centre. (3) The by-laws may prescribe offences for contraventions of the by-laws and prescribe maximum penalties of not more than 1 penalty unit for offences against the by-laws. (4) In this section: "liquor"--see the Liquor Act 2010, section 11. EXHIBITION PARK CORPORATION ACT 1976 - SECT 14 Corporation's annual reports A report prepared by the corporation under the Annual Reports (Government Agencies) Act 2004 for a financial year must include details of-- (a) any approvals given by the Minister under the following provisions of the Act during the year: o section 5 (c) (Functions of corporation) o section 6 (4) (Exercise of corporation's functions) o section 13 (1) (Power to make by-laws); and (b) any direction given by the Minister to the corporation under section 7 (Sufficient revenue policy) during the year. EXHIBITION PARK CORPORATION ACT 1976 - SECT 15 Racing Act 1999 etc not affected This Act does not affect the operation of the Racing Act 1999 or the Gaming and Betting Act 1906. EXHIBITION PARK CORPORATION ACT 1976 - SECT 16 Regulation-making power The Executive may make regulations for this Act. Note A regulation must be notified, and presented to the Legislative Assembly, under the Legislation Act. EXHIBITION PARK CORPORATION ACT 1976 - SCHEDULE 1 Schedule 1 Description of national exhibition centre (see dict, def national exhibition centre) All that piece of land in the Canberra Central and Gungahlin Districts of the Australian Capital Territory containing an area of 40.4151ha more or less; beginning at a point on the northeastern side of Flemington Road on a line bearing 319 degrees 52' 50'' for 87.813m from the intersection of that side of that road with the northwestern side of Northbourne Avenue as described in Computation Sheet D. 2120-6090 catalogued in the Australian Survey Office, Canberra; and bounded thence on the southwest by lines bearing consecutively 357 degrees 22' 30'' for 329.369m and 349 degrees 08' for 204m; thence on the northwest by lines bearing consecutively 189.76m of an arc of radius 380m the chord of which lies to the southeast and bears 16 degrees 33' 30'' for 187.794m, 25 degrees 26' for 55.22m, 37 degrees 10' for 25.218m and 56 degrees 12' for 83.565m; thence on the northeast by lines bearing consecutively 97 degrees for 270m, 120 degrees for 240m and 255.283m of an arc of radius 300m the chord of which lies to the southwest and bears 164 degrees 9' 50'' for 247.65m; thence on the southeast by a line bearing 229 degrees 51' 55'' for 778.512m; thence by a straight line to the beginning point. It was renamed as the National Exhibition Centre Trust Ordinance 1976 by the National Exhibition Centre Trust Ordinance 1982 No 37 (see s 3 (2)). The Australian Capital Territory (Self-Government) Act 1988 (Cwlth), s 34 (4) converted most former Commonwealth ordinances in force in the ACT into ACT enactments. This allowed the ACT Legislative Assembly to amend and repeal the laws. This Act was converted into an ACT enactment on 11 May 1989 (self-government day). As with most ordinances in force in the ACT, the name was changed from Ordinance to Act by the Self-Government (Citation of Laws) Act 1989 No 21, s 5 on 11 May 1989 (self-government day). Before 11 May 1989, ordinances commenced on notification day unless otherwise stated (see Seat of Government (Administration) Act 1910 (Cwlth), s 12). It was renamed as the Exhibition Park Corporation Act 1976 by the Financial Management Legislation Amendment Act 2005 A2005-52 (see amdt 1.194).
