Australian Capital Territory Consolidated Acts(1) The Minister may, upon application made to him or her in writing, approve, subject to such conditions (if any) as he or she thinks necessary, the anchoring of a buoy in a lake or the erection of a wharf or jetty within a lake area.
Note A fee may be determined under s 54 (Determination of fees) for an application under this subsection.
(2) A person commits an offence if—
(a) the person anchors a buoy in a lake; and
(b) the anchoring is not approved under subsection (1).
Maximum penalty: 5 penalty units.
(3) A person commits an offence if—
(a) the person erects a wharf or jetty in a lake area; and
(b) the erection is not approved under subsection (1).
Maximum penalty: 5 penalty units.
(4) A person commits an offence if—
(a) the person moors a boat in a mooring area under section 15; and
(b) the boat is moored to something other than—
(i) a buoy anchored in accordance with an approval under subsection (1); or
(ii) a wharf or jetty erected in accordance with an approval under subsection (1).
Maximum penalty: 5 penalty units.
(5) An offence against this section is a strict liability offence.
