LEGISLATION ACT 2001 - SECT 219

    (1)     The appointer may—

        (a)     decide the terms of the acting appointment, including any remuneration and allowances; and

        (b)     end the appointment at any time.

Example—par (b)

A appoints X to act in a position for 10 months. Two months after X begins to act, A ends the appointment.

Note 2     An example is part of the Act, is not exhaustive and may extend, but does not limit, the meaning of the provision in which it appears (see s 126 and s 132).

    (2)     The power to end the acting appointment is exercisable in the same way, and subject to the same conditions, as the power to make the acting appointment.

Example

If the power to make the acting appointment is exercisable only on the recommendation of a body, the power to end the appointment is exercisable only on the recommendation of the body.
