LAND TITLES ACT 1925 - SECT 50A

Issue of duplicate when document lost or destroyed

    (1)     When a duplicate memorandum of lease, mortgage or encumbrance or a duplicate notice of determination made under the Rates and Land Rent (Relief) Act 1970 , section 3 has been lost or destroyed, the registrar-general upon being satisfied as to the loss or destruction may issue a certificate of lease, mortgage, encumbrance or notice of determination, as the case may be, in place thereof.

Note     If a form is approved under s 140 (Approved forms) for a certificate or notice, the form must be used.

    (2)     The issue of the certificate shall be subject to such conditions as to advertisement, notice and indemnity as the registrar-general thinks fit.

    (3)     Upon the issue of a certificate under this section, the registrar-general shall enter in the register a memorandum that the certificate has been issued, and thereafter the certificate shall be produced to the registrar-general on every occasion upon which production of the duplicate lease, mortgage encumbrance or notice of determination would be required if the certificate had not been issued.
