MAGISTRATES COURT ACT 1930 - SECT 320

Depositions to be given to registrar

    (1)     If depositions are taken before a magistrate under section 318, there must be given to the registrar—

        (a)     the record of the depositions made in accordance with section 316 (2) or the document containing the depositions as taken down in writing and signed in accordance with section 316 (3); and

        (b)     any documents produced to the magistrate.

    (2)     If documents are produced by a person not giving evidence, the documents, must, when given to the registrar, be accompanied by a certificate signed by the magistrate stating the name of the person producing them.

    (3)     If the court is satisfied that the person who made the depositions is not in the ACT, his or her depositions may be read by any party.

    (4)     Any documents so given to the registrar may, subject to all just exceptions, be put in at the hearing as if produced at the hearing by the person producing them.
