WILLS ACT 1968 - NOTES

Dictionary

(see s 2)

Note 1     The Legislation Act contains definitions and other provisions relevant to this Act.

Note 2     For example, the Legislation Act, dict, pt 1, defines the following terms:

              •     ACT

              •     civil partner

              •     civil partnership

              •     daily newspaper

              •     domestic partner (see s 169 (1))

              •     estate

              •     interest

              •     land

              •     person.

"personal property" includes leasehold property, and a share or interest in personal property.

"real property" includes an estate, right or interest in real property.

"registrar" means the registrar of the Supreme Court.

"will" includes—

        (a)     for this Act generally—a codicil; and

        (b)     for part 4 (Miscellaneous)—see section 17.

3     Legislation history

The Wills Act 1968 was originally the Wills Ordinance 1968. It became an ACT Act on self-government (11 May 1989).

Before 11 May 1989, ordinances commenced on their notification day unless otherwise stated (see Seat of Government (Administration) Act 1910 (Cwlth), s 12).

After 11 May 1989 and before 10 November 1999, Acts commenced on their notification day unless otherwise stated (see Australian Capital Territory (Self-Government) Act 1988 (Cwlth) s 25).

Editorial changes

The Legislation Act 2001, part 11.3 authorises the Parliamentary Counsel to make editorial amendments and other changes of a formal nature when preparing a law for republication. Editorial changes do not change the effect of the law, but have effect as if they had been made by an Act commencing on the republication date (see Legislation Act 2001, s 115 and s 117). The changes are made if the Parliamentary Counsel considers they are desirable to bring the law into line, or more closely into line, with current legislative drafting practice.

This republication does not include amendments made under part 11.3 (see endnote 1).

Uncommenced provisions and amendments
