LAND (PLANNING AND ENVIRONMENT) REGULATIONS(AMENDMENT) (NO. 20 OF 1995) 

- TABLE OF PROVISIONS

1. Commencement  
2.   In these Regulations, "Principal Regulations" means the Land (Planning and Environment) Regulations.  
3.   After regulation 11 of the Principal Regulations the following regulation is inserted:  
4.   Regulation 12 of the Principal Regulations is amended by omitting subregulation (1).  
5.   Regulation 7 of Subordinate Law No. 53 of 1993 is repealed.

Commencement

1.  These Regulations commence on the day on which they are notified in the Gazette.

2.  In these Regulations, "Principal Regulations" means the Land (Planning and Environment) Regulations.
 Insertion

3.  After regulation 11 of the Principal Regulations the following regulation is inserted:
 Determination of amount under paragraph 184 (b) of the Act
"11A.  (1)  For the purposes of paragraph 184 (b) of the Act, the
prescribed amount shall be determined--
         (a)     in the case of a variation of a lease to be executed in response to an
old application--in accordance with regulations 12, 13 and 14 and Schedule
3 as in force immediately before the commencement of Subordinate Law No. 53 of
1993; and
         (b)     in the case of any other variation of a lease--in accordance with
regulations 12, 13 and 14 and Schedule 3.
"(2)  In this regulation--  'Fyshwick land'
means land, comprised in a lease of Territory land, all of which lies within the
Division of Fyshwick shown in Deposited Plan 5574 kept in the Office of the
Registrar-General;'old application' means an application under
section 226 of the Act that has been lodged with the Minister on or before the
specified date;'specified date' means--
         (a)     in the case of an application in respect of land other than Fyshwick
land--14 September 1993; and
         (b)     in the case of an application in respect of Fyshwick land--14
September 1994.".

4.  Regulation 12 of the Principal Regulations is amended by omitting subregulation (1).
 Repeal
