FOOD ACT 1992 (REPEALED) - SECT 59

Application for relief against seizure

    (1)     A person claiming to be entitled to anything seized under this part may—

        (a)     in the case of food having a maximum durable shelf life of 7 days—within 72 hours after the seizure of the food; and

        (b)     in any other case—within 10 days after the seizure of the thing;

apply to a court of competent jurisdiction in the Territory for an order disallowing the seizure.

    (2)     An application under subsection (1) shall be made in accordance with the relevant rules of court and shall not be heard unless the applicant has served a copy of the application on the public health officer responsible for the relevant seizure.
