A Bill for an Act to amend the Airports Act 1996,
and for related purposes
The Parliament of Australia enacts:
This
Act may be cited as the Airports Amendment Act 2002.
(1) Each provision of this Act specified in column 1 of the table
commences, or is taken to have commenced, on the day or at the time specified in
column 2 of the table.

Note: This table relates only to the provisions of this Act
as originally passed by the Parliament and assented to. It will not be expanded
to deal with provisions inserted in this Act after assent.
(2) Column 3 of the table is for additional information that is not part
of this Act. This information may be included in any published version of this
Act.
(3) If a provision covered by item 2 of the table does not commence
within the period of 6 months beginning on the day on which this Act receives
the Royal Assent, it commences on the first day after the end of that
period.
Each Act that is specified in a Schedule to this Act is amended or
repealed as set out in the applicable items in the Schedule concerned, and any
other item in a Schedule to this Act has effect according to its
terms.
1 Before section 44 (in Division 4 of
Part 3)
Insert:
This Division applies to an airport-operator company for:
(a) a core regulated airport; or
(b) an airport specified in the regulations;
if there is an airport lease for the airport.
2 At the end of
section 252
Add:
(2) Despite section 49A of the Acts Interpretation Act 1901,
regulations made under this Act may make provision for or in relation to a
matter by applying, adopting or incorporating any matter contained in:
(a) the Airside Vehicle Control Handbook dealing with the control of
airside vehicles and published by the airport-operator company for the airport
concerned; or
(b) the document numbered 8168 OPS-611 and known as the Procedures for Air
Navigation Services, Aircraft Operations published by the International Civil
Aviation Organisation;
as in force or existing from time to time.
3 At the end of clause 5 of the
Schedule
Add:
(3) However, the regulations may declare that a particular person is taken
not to be an associate of another person for the purposes of the ownership
provisions or specified parts of the ownership provisions.
4 After paragraph 9(1)(c) of the
Schedule
Insert:
(ca) a prescribed kind of:
(i) direct control interest in a company; or
(ii) stake in a company;
being an interest or a stake held by such persons as are
prescribed;
Note: The heading to clause 9 of the Schedule is
replaced by the heading “Certain interests and stakes to be
disregarded”.
