The Parliament of Australia enacts:

1 Short title
5
This Act is the Agricultural and Veterinary Chemicals Legislation
6
Amendment (Australian Pesticides and Veterinary Medicines
7
Authority Board and Other Improvements) Act 2019.

2 Commencement
9
(1) Each provision of this Act specified in column 1 of the table
10
commences, or is taken to have commenced, in accordance with
11

Other Improvements) Bill 2019

(2) Subdivision B provides for approval and registration for active
21
constituents, chemical products or labels after assessment against
22
certain criteria. Section 10 provides for applications to be made
23
and applications must meet the application requirements in
24
section 8A.

(3) The APVMA must complete a preliminary assessment of an
26
application. If the application passes preliminary assessment, the

APVMA must notify the applicant and publish a summary of the

application (section 11).

(4) Before determining certain applications that have passed
3
preliminary assessment, the APVMA must publish a notice
4
inviting public submissions (sections 12 and 13).

(5) The APVMA must approve an active constituent or label, or
6
register a chemical product, if specified criteria are met
7
(section 14).

(5A) Subdivision C provides for approval and registration for a
11
prescribed active constituent, prescribed chemical product or
12
prescribed label for containers for a chemical product.
13
Sections 14C, 14D and 14E provide for applications to be made
14
and applications must meet the application requirements in
15
section 8A.
16
(5B) If an application meets the application requirements, the APVMA
17
must approve the active constituent or label, or register the
18
chemical product, if no disqualifying circumstances exist in
19
relation to the applicant.

14C Applications for approval of prescribed active constituents

(1) A person may apply to the APVMA for approval of a prescribed
4
active constituent.

For prescribed active constituent, see subsection (4).

(2) The application must meet the application requirements.

(3) The APVMA may alter the application with the written consent of
9
the applicant.

(4) A prescribed active constituent is an active constituent that:
11
(a) is for a proposed or existing chemical product; and
12
(b) is of a kind:
13
(i) prescribed by the regulations for the purposes of this
14
subparagraph; or
15
(ii) determined by the APVMA under subsection (6).
16
(5) The APVMA must not determine a kind of active constituent under
17
subsection (6) unless it is satisfied that the kind of active
18
constituent would meet the safety criteria.
19
(6) The APVMA may, by legislative instrument, determine a kind of
20
active constituent for the purposes of subparagraph (4)(b)(ii).
21
Decision on application
22
(7) The APVMA must approve the active constituent that is the subject
23
of the application if it is satisfied that:
24
(a) the application meets the application requirements; and
25
(b) the active constituent is a prescribed active constituent; and
26
(c) none of the circumstances determined in an instrument under
27
subsection (9) apply in relation to the applicant.

(9) The APVMA may, by legislative instrument, determine
4
circumstances for the purposes of paragraph (7)(c).

14D Applications for registration of prescribed chemical products
6
(1) A person may apply to the APVMA for registration of a prescribed
7
chemical product.

For prescribed chemical product, see subsection (4).

(2) The application must meet the application requirements.

(3) The APVMA may alter the application with the written consent of
12
the applicant.

(4) A prescribed chemical product is a chemical product that is of a
14
kind:
15
(a) prescribed by the regulations for the purposes of this
16
paragraph; or
17
(b) determined by the APVMA under subsection (6).
18
(5) The APVMA must not determine a kind of chemical product under
19
subsection (6) unless it is satisfied that the kind of chemical
20
product would:
21
(a) meet the safety criteria, the trade criteria and the efficacy
22
criteria; or
23
(b) comply with the established standard for the kind of chemical
24
product.
25
(6) The APVMA may, by legislative instrument, determine a kind of
26
chemical product for the purposes of paragraph (4)(b).

Decision on application
1
(7) The APVMA must register the chemical product that is the subject
2
of the application if it is satisfied that:
3
(a) the application meets the application requirements; and
4
(b) the chemical product is a prescribed chemical product; and
5
(c) none of the circumstances determined in an instrument under
6
subsection (9) apply in relation to the applicant.

(8) Otherwise, the APVMA must refuse the application.

label for containers for a chemical product.

(2) The application must meet the application requirements.

(4) A prescribed label for containers for a chemical product is a

label:

(a) for containers for a chemical product; and
26
(b) that is of a kind:

(i) prescribed by the regulations for the purposes of this
28
subparagraph; or
29
(ii) determined by the APVMA under subsection (6).

(5) The APVMA must not determine a kind of label under

subsection (6) unless it is satisfied that the kind of label would:
2
(a) meet the labelling criteria; or
3
(b) comply with the established standard for the chemical
4
product.

(6) The APVMA may, by legislative instrument, determine a kind of
6
label for the purposes of subparagraph (4)(b)(ii).

(7) Without limiting subsection (6), a kind of label may be described
8
by reference to a kind of chemical product.

Decision on application

(8) The APVMA must approve the label that is the subject of the
11
application if it is satisfied that:
12
(a) the application meets the application requirements; and
13
(b) the label that is the subject of the application is a prescribed
14
label for containers for a chemical product; and
15
(c) none of the circumstances determined in an instrument under
16
subsection (10) apply in relation to the applicant.

(b) the application satisfies the requirements prescribed by the

regulations for the purposes of this paragraph.

(4) The total length of all extensions of a protection period, in relation

to particular protected information, must not be more than 5 years.

in the instrument of appointment. The period must not exceed 4

years.

occasion after the appointed Board member's first appointment.

(2) An appointed Board member is to be paid the allowances that are
23
prescribed by the regulations.

(3) This section has effect subject to the Remuneration Tribunal Act
25
1973.

22 Paid work
27
An appointed Board member must not engage in any paid work
28
that, in the Minister's opinion, conflicts or could conflict with the
29
proper performance of the member's duties.

23 Leave of absence
1
(1) The Minister may grant leave of absence to the Chair on the terms
2
and conditions that the Minister determines.
3
(2) The Chair may grant leave of absence to any other appointed
4
Board member on the terms and conditions that the Chair
5
determines.
6
24 Resignation of appointment
7
(1) An appointed Board member may resign the member's
8
appointment by giving the Minister a written resignation.
9
(2) The resignation takes effect on the day it is received by the
10
Minister or, if a later day is specified in the resignation, on that
11
later day.
12
25 Termination of appointment
13
The Minister may terminate the appointment of an appointed
14
Board member:
15
(a) for misbehaviour; or
16
(b) if the appointed Board member is unable to perform the
17
duties of the member's office because of physical or mental
18
incapacity; or
19
(c) if the appointed Board member:
20
(i) becomes bankrupt; or
21
(ii) applies to take the benefit of any law for the relief of
22
bankrupt or insolvent debtors; or
23
(iii) compounds with the member's creditors; or
24
(iv) makes an assignment of the member's remuneration for
25
the benefit of the member's creditors; or
26
(d) if the appointed Board member is absent, except on leave of
27
absence, from 3 consecutive meetings of the Board; or
28
(e) if the appointed Board member engages in paid work that, in
29
the Minister's opinion, conflicts or could conflict with the
30
proper performance of the member's duties (see section 22);

27 Convening meetings

(1) The Board must hold such meetings as are necessary for the
14
efficient performance of its functions.

(2) The Chair:

(a) may convene a meeting at any time; and
17
(b) must convene at least 4 meetings each calendar year; and
18
(c) must convene a meeting within 30 days after receiving a
19
written request to do so from another Board member.

27A Presiding at meetings
21
(1) The Chair must preside at all meetings at which the Chair is
22
present.
23
(2) If the Chair is not present at a meeting, the other Board members
24
present must appoint one of themselves to preside.

27B Quorum
26
(1) At a meeting of the Board, a quorum is constituted by a majority of
27
Board members.

is no longer a quorum present;

the remaining Board members at the meeting constitute a quorum

for the purpose of any deliberation or decision at that meeting with
9
respect to that matter.

27C Voting at meetings

(1) A question arising at a meeting of the Board is to be determined by
12
a majority of the votes of the Board members present and voting.
13
(2) The person presiding at the meeting of the Board has a deliberative
14
vote and, if the votes are equal, a casting vote.
15
27D Conduct of meetings
16
The Board may, subject to this Subdivision, regulate proceedings
17
at its meetings as it considers appropriate.

Section 33B of the Acts Interpretation Act 1901 contains further
19
information about the ways in which Board members may participate
20
in meetings.

27E Minutes

(1) The Board must keep minutes of its meetings.
23
(2) The Board must give the Secretary of the Department a copy of the
24
minutes, and the Board papers, from each meeting within 20
25
business days of the meeting.

27F Decisions without meetings
27
(1) The Board is taken to have made a decision at a meeting if:
28

decision, or reasonable efforts were made to inform all the
7
Board members of the proposed decision.

(2) Subsection (1) applies only if the Board:
9
(a) has determined that it may make decisions of that kind
10
without meeting; and
11
(b) has determined the method by which Board members are to
12
indicate agreement with proposed decisions.
13
(3) For the purposes of paragraph (1)(a), a Board member is not
14
entitled to vote on a proposed decision if the Board member would
15
not have been entitled to vote on that proposal if the matter had
16
been considered at a meeting of the Board.
17
(4) The Board must keep a record of decisions made in accordance
18
with this section.
19
(5) The Board must give the Secretary of the Department details of
20
each decision made in accordance with this section within 20
21
business days of the decision being made.

Subdivision D--Minister may give directions to the Board

(1) The Minister may give written directions to the Board about the
25
performance of its functions or the exercise of its powers.

(2) The Board must comply with a direction under subsection (1).

under the Public Governance, Performance and Accountability Act

42 Application and saving provisions

(1)
The amendments of section 51 of the Agricultural and Veterinary

Chemicals (Administration) Act 1992 made by this Schedule apply in
15
relation to each calendar year that begins after the commencement of
16
this item.

(2)
The amendments of Part 6 of the Agricultural and Veterinary
18
Chemicals (Administration) Act 1992 made by this Schedule do not
19
affect the validity of a corporate plan, or a variation of a corporate plan,
20
approved by the Minister before the commencement of this item.

(3)
The amendments of section 61 of the Agricultural and Veterinary
22
Chemicals (Administration) Act 1992 made by this Schedule apply in
23
relation to each reporting period (within the meaning of the Public
24
Governance, Performance and Accountability Act 2013) that ends after
25
the commencement of this item.

43 Transitional provision
--transfer of records and

documents of Advisory Board to the APVMA

(1)
This item applies to any records or documents that were in the
29
possession of the Advisory Board immediately before the
30
commencement of this item.
