1 Short title

This Act may be cited as the Asbestos-related Claims
8
(Management of Commonwealth Liabilities) Act 2005.

2 Commencement
1
(1) Each provision of this Act specified in column 1 of the table
2
commences, or is taken to have commenced, in accordance with
3
column 2 of the table. Any other statement in column 2 has effect
4
according to its terms.

3 Definitions
13
(1) In this Act:
14
asbestos-related claim means a claim for the payment of
15
compensation or damages to a person in respect of an
16
asbestos-related condition suffered by the person or another person
17
arising from a breach of a common law or statutory duty of care
18
by:
19
(a) the Commonwealth; or

(b) an entity that was a Commonwealth authority when the

breach of the duty of care occurred.

asbestos-related condition means:
3
(a) asbestosis; or
4
(b) an asbestos-induced carcinoma; or
5
(c) an asbestos-related non-malignant pleural disease; or
6
(d) mesothelioma; or
7
(e) any other condition that is caused by exposure to asbestos.

claim:
9
(a) means a claim or demand of any kind (whether or not
10
involving legal proceedings); and
11
(b) includes proceedings of any kind.
12
Comcare means the body corporate established by section 68 of
13
the Safety, Rehabilitation and Compensation Act 1988.
14
Commonwealth authority means:
15
(a) a body corporate that is established for a public purpose by a
16
law of the Commonwealth or of a Territory (other than the
17
Australian Capital Territory, the Northern Territory or
18
Norfolk Island) that is not a general law allowing
19
incorporation as a company or body corporate; or
20
(b) a body corporate that:
21
(i) is incorporated under a law of the Commonwealth or of
22
a State or Territory; and
23
(ii) is a body corporate in which the Commonwealth, or a
24
body corporate covered by paragraph (a), has a
25
controlling interest (within the meaning of the Safety,
26
Rehabilitation and Compensation Act 1988); or
27
(c) a body corporate that is declared to be a Commonwealth
28
authority for the purposes of this Act under subsection 4(1);
29
but does not include:
30
(d) Comcare; or
31
(e) the Australian Postal Corporation; or
32
(f) Telstra Corporation Limited; or

(g) a body corporate that is declared not to be a Commonwealth

authority for the purposes of this Act under subsection 4(2);
2
or
3
(h) a body corporate that is a subsidiary of a body corporate
4
covered by paragraph (e), (f) or (g).

contract of insurance includes a contract which, however
6
expressed and in whatever form, is in substance an indemnity or
7
guarantee.

court (except in section 15) includes:
9
(a) a tribunal; and
10
(b) any judge or person acting judicially or authorised by law or
11
consent of parties to hear, receive and examine evidence.

Finance Minister means the Minister who administers the
13
Financial Management and Accountability Act 1997.
14
liability means a liability of any kind (whether actual, potential or
15
contingent) but does not include a liability arising under:
16
(a) a contract of insurance; or
17
(b) a judgment or order of a court that is not stayed or subject to
18
appeal when Part 2 of this Act commences; or
19
(c) a settlement that takes the form of a written agreement
20
entered into before Part 2 of this Act commences.

subject to appeal: a judgment or order is subject to appeal until:
22
(a) any applicable time limits for lodging an appeal (however
23
described) against the judgment or order have expired; and
24
(b) if there is such an appeal against the judgment or order--the
25
appeal (and any subsequent appeals) have been finally
26
disposed of.

Meaning of subsidiary
28
(2) For the purposes of this Act, the question whether a body corporate
29
is a subsidiary of another body corporate is to be determined in the
30
same manner as that question is determined under the
31
Corporations Act 2001.

4 Declarations--Commonwealth authorities
1
Body corporate is a Commonwealth authority
2
(1) The Minister may, by written instrument, declare that a body
3
corporate is, from the time that the instrument is made, a
4
Commonwealth authority for the purposes of this Act if, at that
5
time:
6
(a) the body corporate is incorporated under a law of the
7
Commonwealth or of a State or Territory; and
8
(b) either:
9
(i) the Commonwealth; or
10
(ii) a body corporate that is established for a public purpose
11
by a law of the Commonwealth or of a Territory (other
12
than the Australian Capital Territory, the Northern
13
Territory or Norfolk Island) that is not a general law
14
allowing incorporation as a company or body corporate;
15
has a substantial interest (within the meaning of the Safety,
16
Rehabilitation and Compensation Act 1988) in the body
17
corporate.

Note:
Subsection 33(3) of the Acts Interpretation Act 1901 provides for the
19
repeal, variation etc. of instruments.

Body corporate is not a Commonwealth authority
21
(2) The Minister may, by written instrument, declare that a body
22
corporate is not, from the time that the instrument is made, a
23
Commonwealth authority for the purposes of this Act.

Note:
Subsection 33(3) of the Acts Interpretation Act 1901 provides for the
25
repeal, variation etc. of instruments.

(3) The Minister must publish a copy of an instrument made under
28
subsection (1) or (2) in the Gazette.
29
(4) A failure to comply with subsection (3) does not affect the validity
30
of any declaration made under this section.

(5) An instrument made under subsection (1) or (2) is not a legislative
2
instrument.

5 Transfer of liabilities to Comcare
4
Claims against Commonwealth or authority on or before
5
commencement
6
(1) If an asbestos-related claim was made against the Commonwealth
7
or a Commonwealth authority on or before the commencement of
8
this Part then, on the commencement of this Part:
9
(a) a liability of the Commonwealth or the authority that relates
10
to the claim ceases to be a liability of the Commonwealth or
11
the authority and becomes a liability of Comcare; and
12
(b) Comcare becomes the successor in law in relation to the
13
liability.
14
Claims against Commonwealth or authority after commencement
15
(2) If an asbestos-related claim is made against the Commonwealth or
16
a Commonwealth authority after the commencement of this Part
17
then, at the time the claim is made:
18
(a) a liability of the Commonwealth or the authority that relates
19
to the claim ceases to be a liability of the Commonwealth or
20
the authority and becomes a liability of Comcare; and
21
(b) Comcare becomes the successor in law in relation to the
22
liability.
23
Claims against Comcare on or after commencement
24
(3) If, on or after the commencement of this Part, a person could make
25
an asbestos-related claim against the Commonwealth or a
26
Commonwealth authority then:
27
(a) the person may make the claim against Comcare; and
28
(b) if the person makes the claim against Comcare--at the time
29
the claim is made:
30
(i) a liability of the Commonwealth or the authority that
31
relates to the claim ceases to be a liability of the

Commonwealth or the authority and becomes a liability

of Comcare; and
2
(ii) Comcare becomes the successor in law in relation to the
3
liability.

6 Transfer of liabilities from Comcare

Liabilities may be transferred from Comcare
6
(1) The Minister may, by written instrument, declare that a liability
7
that ceased to be a liability of a Commonwealth authority and
8
became a liability of Comcare under section 5 ceases to be a
9
liability of Comcare and becomes a liability of:
10
(a) the authority; or
11
(b) an entity that is a successor in law of the authority.
12
(2) If the Minister makes a written instrument under subsection (1)
13
then, immediately after the instrument is made:
14
(a) the liability ceases to be a liability of Comcare and becomes
15
a liability of the authority or entity (as the case requires); and
16
(b) the authority or entity becomes the successor in law in
17
relation to the liability.

(3) The Minister must publish a copy of an instrument made under
20
subsection (1) in the Gazette.
21
(4) A failure to comply with subsection (3) does not affect the validity
22
of any declaration made under this section.

Instruments not legislative instruments
24
(5) An instrument made under subsection (1) is not a legislative
25
instrument.

Minister may not repeal, vary etc. instruments
27
(6) Subsection 33(3) of the Acts Interpretation Act 1901 does not
28
apply in relation to this section.

7 Certain consequences of transfer
1
Application of section
2
(1) This section applies in relation to a liability that, under section 5 or
3
6, ceases to be a liability of one entity (the transferor) and
4
becomes a liability of another entity (the receiver) at a particular
5
time (the transfer time).

Contracts of insurance
7
(2) From the transfer time, any contract of insurance to which the
8
transferor was, or was taken to be, a party immediately before the
9
transfer time has effect in relation to the liability as if:
10
(a) the receiver were substituted for the transferor as a party to
11
the contract; and
12
(b) any reference in the contract to the transferor were (except in
13
relation to things that happened before that time) a reference
14
to the receiver.
15
Conduct of actions, enforcement of judgments etc.
16
(3) Without limiting the generality of section 5 or 6:
17
(a) if, at the transfer time, action is being taken relating to the
18
liability--the receiver must, immediately after the transfer
19
time, take over the conduct of that action; and
20
(b) if, at the transfer time, action is being taken relating to the
21
liability before a court--the receiver:
22
(i) replaces the transferor as a party to the action from the
23
transfer time; and
24
(ii) may, if the receiver thinks it appropriate to do so, apply
25
on or after the transfer time to the court to join any other
26
person as a party to the action; and
27
(iii) may, on or after the transfer time, conduct or settle the
28
action; and
29
(c) if, at the transfer time, a judgment relating to the liability has
30
been obtained in favour of the transferor but not enforced--
31
the receiver may take such steps as are necessary to enforce
32
the judgment.

Transferor must comply with certain requirements of receiver

(4) The transferor must comply with any reasonable requirement of the
2
receiver:
3
(a) relating to the conduct of any action in respect of the
4
liability; or
5
(b) made for the purposes of assisting the receiver to manage the
6
liability;
7
including a reasonable requirement that the transferor sign any
8
documents.

8 Appropriation in respect of certain liabilities transferred to
4
Comcare
5
(1) There is to be paid to Comcare such amounts as are necessary to
6
enable Comcare to discharge any liability that is a liability of
7
Comcare as a result of the operation of this Act.
8
(2) The amounts payable to Comcare under this section are to be paid
9
out of the Consolidated Revenue Fund, which is appropriated
10
accordingly.

9 Money of Comcare

(1) The Finance Minister may give written directions as to the amounts
13
in which, and the times at which, money referred to in section 8 is
14
to be paid to Comcare.
15
(2) A direction made under subsection (1) is not a legislative
16
instrument.

10 Access to records
18
(1) If Comcare has the function of assuming and managing a liability
19
as a result of the operation of this Act, records (within the meaning
20
of the Archives Act 1983) that:
21
(a) are in the possession, custody or control of the
22
Commonwealth or a Commonwealth authority; and
23
(b) relate to the liability;
24
must be made available to Comcare by the Commonwealth or the
25
authority.
26
(2) This section does not authorise a Commonwealth record (within
27
the meaning of the Archives Act 1983) to be transferred or
28
otherwise dealt with except in accordance with the provisions of
29
that Act.

11 Disclosure of information

Comcare may require disclosure of information
2
(1) Comcare may, by written notice, require the chief executive officer
3
(however described) of an entity to give Comcare information that:
4
(a) the chief executive officer knows or can reasonably acquire;
5
and
6
(b) relates to a liability that, under section 5, has ceased to be a
7
liability of the entity and has become a liability of Comcare;
8
and
9
(c) the Chief Executive Officer of Comcare believes, on
10
reasonable grounds, it is necessary for Comcare to know in
11
order for Comcare to carry out the function conferred on it by
12
section 12.

Requirement to disclose information
14
(2) If the chief executive officer (however described) of an entity is
15
given a notice under subsection (1), he or she must ensure that it is
16
complied with as soon as practicable after it is given.
17
(3) The chief executive officer (however described) of an entity is not
18
excused from ensuring that a notice given to him or her under
19
subsection (1) is complied with on the ground that giving
20
information covered by the notice would contravene the provisions
21
of any other enactment.
22
(4) A person is not liable to:
23
(a) any proceedings for contravening any other law; or
24
(b) civil proceedings for loss, damage or injury of any kind
25
suffered by another person;
26
merely because the person gives information to Comcare to ensure
27
that a notice under subsection (1) is complied with.
28
12 Additional function of Comcare
29
In addition to the functions conferred on Comcare under other
30
Acts, Comcare has the function of assuming and managing all

liabilities that are liabilities of Comcare as a result of the operation

of this Act.

See section 70 of the Safety, Rehabilitation and Compensation Act

1988 for powers relating to this function.

13 Directions by Minister
5
(1) The Minister may, by notice in writing given to the Chief
6
Executive Officer of Comcare, give a direction to Comcare with
7
respect to:
8
(a) the performance of the function conferred on Comcare by
9
section 12; or
10
(b) the exercise of its powers to do anything in connection with
11
the performance of that function;
12
otherwise than in relation to a particular case.
13
(2) Comcare must comply with a direction given under subsection (1).
14
(3) This section does not affect the application of section 28 of the
15
Commonwealth Authorities and Companies Act 1997 in relation to
16
Comcare.
17
(4) A notice given under subsection (1) is not a legislative instrument.
18
14 Consent required for delegation
19
(1) Comcare must obtain the written consent of the Minister before
20
delegating to a person under section 73B of the Safety,
21
Rehabilitation and Compensation Act 1988:
22
(a) the function conferred on Comcare by section 12 of this Act;
23
or
24
(b) a power to do anything in connection with the performance
25
of that function.
26
(2) Subsection (1) does not apply if the person to whom the power is
27
delegated is a member of the staff of, or a consultant to, Comcare.

15 Compensation for acquisition of property
1
(1) If the operation of this Act would result in an acquisition of
2
property from a person otherwise than on just terms, the
3
Commonwealth is liable to pay a reasonable amount of
4
compensation to the person.
5
(2) If the Commonwealth and the person do not agree on the amount
6
of the compensation, the person may institute proceedings in a
7
court of competent jurisdiction for the recovery from the
8
Commonwealth of such reasonable amount of compensation as the
9
court determines.
10
(3) The Consolidated Revenue Fund is appropriated for the purposes
11
of this section.

(4) In this section:
13
acquisition of property has the same meaning as in paragraph
14
51(xxxi) of the Constitution.
15
just terms has the same meaning as in paragraph 51(xxxi) of the
16
Constitution.

16 Regulations
18
The Governor-General may make regulations prescribing matters:
19
(a) required or permitted by this Act to be prescribed; or
20
(b) necessary or convenient to be prescribed for carrying out or
21
giving effect to this Act.
