A Bill for an Act to amend the law relating to agriculture, fisheries and forestry, and for related purposes

The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Agriculture, Fisheries and Forestry Legislation Amendment Act (No. 1) 1998.

2 Commencement

(1) Subject to subsection (2), this Act commences on the day on which it receives the Royal Assent.

(2) Schedule 1 commences, or is taken to have commenced, on 1 January 1999.

3 Schedule(s)

Subject to section 2, each Act that is specified in a Schedule to this Act is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this Act has effect according to its terms.

Schedule 1—Repeal of the Dried Vine Fruits Equalization Act 1978 and saving provision

Part 1—Repeal of the Dried Vine Fruits Equalization Act 1978

1 The whole of the Act

Repeal the Act.

Part 2—Saving provision

2 Saving provision

(1) Despite its repeal, the Dried Vine Fruits Equalization Act 1978, as in force immediately before 1 January 1999, continues to apply in relation to all export sales of exported dried fruit to which a separate account for a previous season relates.

(2) In this item:

previous season means a season starting on 1 January 1997 or 1 January 1998.

Schedule 2—Amendment of the Pig Industry Act 1986


1 Section 3

Insert:

AFC Processed Meats Forum means those members of the Australian Food Council who are also members of the Processed Meats Forum of that Council.

2 Section 3

Insert:

Australian Food Council means the body registered as a company under the Corporations Law under that name.

3 Section 3 (paragraph (b) of the definition of eligible industry body)

Repeal the paragraph, substitute:

(b) the AFC Processed Meats Forum; or

4 Paragraph 42(1)(c)

Omit “National Meat Processors’ Association”, substitute “AFC Processed Meats Forum”.

5 Subsection 46(3)

Omit “National Meat Processors’ Association”, substitute “AFC Processed Meats Forum”.
