The Parliament of Australia enacts:

1 Short title
5
This Act is the Australian Nuclear Science and Technology
6
Organisation Amendment Act 2017.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

scientific research, innovation and training includes the
7
following, whether or not related to nuclear science and nuclear
8
technology:

(a) any activities in the fields of natural or applied science
10
(including engineering and technology) for the extension or
11
application of knowledge;
12
(b) any activities that involve innovation or high levels of
13
technical risk for the purposes of creating new or improved
14
materials, products, devices or processes;
15
(c) the education and training of persons in matters related to
16
activities mentioned in paragraph (a) or (b).

6A Constitutional limits
3
(1) The Organisation may perform its functions only:
4
(a) for purposes relating to activities that are peculiarly adapted
5
to the government of a nation and cannot otherwise be
6
carried on for the benefit of the nation; or
7
(b) for purposes relating to trade and commerce:
8
(i) between Australia and places outside Australia; or
9
(ii) among the States; or
10
(iii) within a Territory, between a State and a Territory or
11
between 2 Territories; or
12
(c) for purposes relating to postal, telegraphic, telephonic or
13
other like services; or
14
(d) for purposes relating to the security or defence of Australia;
15
or
16
(e) for purposes relating to astronomical and meteorological
17
observations; or
18
(f) for purposes relating to statistics; or
19
(g) for purposes relating to weights and measures; or
20
(h) for purposes relating to copyrights, patents of inventions and
21
designs, and trade marks; or
22
(i) for purposes relating to the provision of medical and dental
23
services; or
24
(j) for purposes related to external affairs, including:
25
(i) giving effect to any international agreement to which
26
Australia is a party; and
27
(ii) addressing matters of international concern; and
28
(iii) by way of the performance of its functions in a place
29
outside Australia; or
30
(k) for purposes relating to the relations of the Commonwealth
31
with the islands of the Pacific; or
32
(l) in, or for purposes relating to, a Territory; or

(m) in, or for purposes relating to, a Commonwealth place (within
1
the meaning of the Commonwealth Places (Application of
2
Laws) Act 1970); or

(n) for purposes relating to matters incidental to the execution of
4
any of the legislative powers of the Parliament or the
5
executive power of the Commonwealth.

(2) A term used in subsection (1) and the Constitution has the same
7
meaning in that subsection as it has in the Constitution.
