The Parliament of Australia enacts:

1 Short title

This Act may be cited as the National Security Information

(Criminal Proceedings) Amendment (Application) Act 2005.

2 Commencement

This Act commences on the day on which it receives the Royal
9
Assent.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

Repeal the section, substitute:

6 Application of Act

(1) Subject to subsection (2), this Act applies to a federal criminal
9
proceeding, whether begun before, on or after the day on which
10
this section commences, if the prosecutor gives notice in writing to
11
the defendant and the court that this Act applies to the proceeding.
12
(2) If the prosecutor gives the notice after the proceeding begins, this
13
Act only applies to the parts of the proceeding that take place after
14
the notice is given.
