The Parliament of Australia enacts:

1 Short title

This Act is the
Ozone Protection and Synthetic Greenhouse Gas
6
(Manufacture Levy) Amendment Act 2022.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

At the same time as Schedule 1 to the
Ozone
Protection and Synthetic Greenhouse Gas
Management Reform (Closing the Hole in
the Ozone Layer) Act 2022
commences.
However, the provisions do not commence
at all if that Schedule does not commence.
Note:
This table relates only to the provisions of this Act as originally

enacted. It will not be amended to deal with any later amendments of

this Act.

(2) Any information in column 3 of the table is not part of this Act.

Information may be inserted in this column, or information in it

may be edited, in any published version of this Act.

3 Interpretation

(1) An expression used in this Act has the same meaning in this Act as
17
it has in the Management Act.

(2) Without limiting subsection (1), section 9 (references to scheduled
19
substances and equipment) of the Management Act applies in
20
relation to this Act in the same way as that section applies in
21
relation to the Management Act.

(3) In determining for the purposes of this Act whether a licence
23
allows the licensee to carry out an activity, disregard any
24
suspension of the licence.

For the effect of a licence suspension, see subsection 19D(4) of the
26
Management Act.

(11) In exercising a delegated power, the delegate must comply with

any written directions of the Minister.

(12) Before the Governor-General makes regulations for the purposes of
5
a provision mentioned in column 1 of an item in the following
6
table, the Minister must be satisfied of the matter, or one or more
7
of the matters, mentioned in column 2 of that item.

(4) The amount of levy imposed by subsection (1) on a licensee in
9
respect of the manufacture of a substance other than an SGG in a
10
reporting period is the amount prescribed, or worked out in
11
accordance with a method prescribed, by the regulations for the
12
purposes of this subsection.

(5) Before the Governor-General makes regulations for the purposes of
14
subsection (4), the Minister must be satisfied that the effect of this
15
Act and the Import Levy Act will be to recover no more than the
16
Commonwealth's likely costs of the kind mentioned in
17
paragraph 65D(a), (b), (c) or (ca) of the Management Act.

(6) For the purposes of subsection (5), disregard any costs that are
19
likely to be offset by fees charged under the Management Act or
20
regulations made under it.

5 Regulations

The Governor-General may make regulations prescribing matters:

(a) required or permitted by this Act to be prescribed by the
26
regulations; or
27
(b) necessary or convenient to be prescribed for carrying out or
28
giving effect to this Act.

14 Application and saving provisions

(1)
The amendments made by this Schedule apply in relation to reporting
31
periods that start on or after the commencement of this item.

this item, continues to apply in relation to reporting periods starting

before that commencement.

force immediately before the commencement of this item, continue in

force (subject to subitem (4)), and may be dealt with, as if they had been

Regulations made for the purposes of a provision of the

Protection and Synthetic Greenhouse Gas (Manufacture Levy) Act 1995

mentioned in column 1 of an item in the following table, that were in

force immediately before the commencement of this item, continue in

force (and may be dealt with) as if they had been made for the purposes

of the provision of that Act mentioned in column 2 of that item, as

amended by this Schedule.
