(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

1 After section 32R

32S Excluded occupations
6
(1) This section applies in relation to an employer and an employee if
7
the employee is employed in an occupation where the rate of death
8
in the workplace is more than 2.5 in 100,000 per year, averaged
9
over a five-year period, as determined by the Australian
10
Government Actuary.

(2) For the purposes of this Act, the most recent notification to the
12
employer:
13
(a) by the Commissioner; and
14
(b) relating to a request by the employer (or by the employer's
15
agent) for the Commissioner to identify any stapled fund for
16
the employee; is taken to be that the Commissioner is
17
satisfied that there is no stapled fund for the employee.
18
(3) On 1 July each year, the Australian Government Actuary must
19
publish a list of occupations where the rate of death in the
20
workplace is more than 2.5 in 100,000 per year, averaged over a
21
five-year period.
22
(4) An employee in an occupation identified by this section is
23
considered not to have a stapled fund.

Note:
The intent of this section is to ensure that the stapling provisions do
25
not apply to workers employed in dangerous occupations.
