The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Safety, Rehabilitation and
5
Compensation Legislation Amendment Act 2014.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

National employer

(1) For the purposes of this Part, a national employer is a corporation
7
that has employer obligations in 2 or more Australian jurisdictions.

Employer obligations
9
(2) For the purposes of this section, a corporation has employer
10
obligations in an Australian jurisdiction if the corporation:
11
(a) is; or
12
(b) apart from this Act, would be;
13
required to meet the obligations of an employer under a workers'
14
compensation law of the Australian jurisdiction to pay premiums,
15
contributions or similar payments.
16
(3) For the purposes of this section, a corporation has employer
17
obligations in an Australian jurisdiction if the corporation:
18
(a) is a self-insurer within the meaning of a workers'
19
compensation law of the Australian jurisdiction; or
20
(b) is a self-insured employer within the meaning of a workers'
21
compensation law of the Australian jurisdiction.

100A Commission may advise about matters that are relevant to the
23
making of an application for a licence
24
The Commission may advise a body corporate about any of the
25
following matters:
26
(a) whether the body corporate is a national employer;
27
(b) any other matter that is relevant to the making of an
28
application for a licence.

23 Application of amendments

(1)
The amendments of the Safety, Rehabilitation and Compensation Act
3
1988 made by this Schedule, so far as they concern an application made
4
under section 102 of that Act, apply in relation to an application if the
5
application was made after the commencement of this item.
6
(2)
The amendments of the Safety, Rehabilitation and Compensation Act
7
1988 made by this Schedule, so far as they concern a decision to:
8
(a) grant a licence under section 103 of that Act; or
9
(b) refuse to grant such a licence;
10
apply in relation to such a decision if the application for the licence
11
concerned was made after the commencement of this item.

the liability under this Act for payments in respect of

injury, loss or damage suffered by, or the death of, some

or all of its employees;

(b)
the acceptance by the authority of the responsibility for
17
managing certain claims under this Act in respect of
18
injury, loss or damage suffered by, or the death of, some
19
or all of its employees.

If a group employer licence covers corporations that belong to
21
a corporate group, this Act applies in relation to some or all of
22
the employees of those corporations in a similar way to the
23
way in which it applies to employees of the Commonwealth,
24
but the application is subject to:
25
(a)
the acceptance by a relevant authority of the whole or a
26
part of the liability under this Act for payments in
27
respect of injury, loss or damage suffered by, or the
28
death of, those employees; and
29
(b)
those corporations being jointly and severally liable to
30
make payments under this Act in respect of that injury,
31
loss, damage or death; and
32
(c)
the acceptance by a relevant authority of the function of
33
managing claims under this Act in respect of that injury,
34
loss, damage or death.

(1A) The Minister's power to give directions to the Commission under

section 89D extends to directions concerning any matter relating to
7
the issue of group employer licences under this Part. Without
8
limiting the matters the directions may deal with, the Minister may
9
give directions concerning:

(a) criteria and procedures for the issue of group employer
11
licences; or
12
(b) the scope of group employer licences and the conditions to
13
which group employer licences having a particular scope
14
may be expressed to be subject; or
15
(c) the exercise by the Commission of the power to vary the
16
conditions to which group employer licences are subject; or
17
(d) criteria and procedures for the extension, suspension or
18
revocation of group employer licences or for varying the
19
scope of group employer licences; or
20
(e) publication of notices about any issue, extension, suspension
21
or revocation of group employer licences or for varying the
22
scope of group employer licences or the conditions to which
23
they are subject; or
24
(f) requirements to be observed by the Commission in relation to
25
the keeping of records, and the periodic reporting of
26
particulars, in relation to group employer licences.

Note:
Criteria for the issue of a group employer licence may address matters
28
relating not only to the licence applied for, but also to other licences
29
that have been issued or granted, or that are being sought.

Example: The head company of a corporate group may be a holding company
1
whose sole purpose is to hold shares in the proposed covered
2
corporations. The holding company is not a corporation (within the
3
meaning of this Act). The application may nominate the holding
4
company to be the key body corporate for the licence.
5
Application fee
6
(11) The proposed covered corporations are jointly and severally liable
7
to pay to Comcare, in respect of the application, an application fee
8
equal to the amount estimated by the Commission to be the cost of
9
considering the application.
10
(12) The Commission must give written notice to the applicant of the
11
amount of the application fee, and:
12
(a) if the notice is given before the application is made--the
13
application fee is to accompany the application; or
14
(b) otherwise--the application fee is to be paid as soon as
15
practicable after the notice is given.
16
107C Withdrawal of application
17
(1) An applicant for a group employer licence may withdraw the
18
application at any time before a decision is made on the
19
application.
20
(2) If the application is withdrawn after receipt by Comcare of the
21
application fee, the Commission may, depending on the extent to
22
which it has already considered the application:
23
(a) request Comcare to refund the application fee entirely; or
24
(b) reduce the application fee by such amount as it considers
25
reasonable having regard to the extent of that consideration,
26
and request Comcare to refund the amount of the reduction.
27
(3) For the purposes of subsection (2), the reference to the extent of
28
the Commission's consideration of an application includes a
29
reference to any act or thing done by Comcare to assist the
30
Commission in that consideration.

107D Issue of group employer licence
1
Scope
2
(1) This section applies if an application under section 107B has been
3
made for the issue of a group employer licence.
4
Issue of licence
5
(2) After considering:
6
(a) the application; and
7
(b) any further information that is provided to the Commission
8
by the applicant for the purpose of enabling consideration of
9
the application; and
10
(c) any other matter that the Commission considers relevant;
11
the Commission may, by written instrument, issue a group
12
employer licence that:
13
(d) is expressed to cover the corporations identified in the licence
14
as covered corporations; and
15
(e) designates one of those corporations as the administration
16
manager for the licence; and
17
(f) either:
18
(i) designates one of those corporations as a relevant
19
authority for the licence; or
20
(ii) designates each of 2 or more of those corporations as a
21
relevant authority for the licence; and
22
(g) designates a body corporate as the key body corporate for the
23
licence.

Criteria for issue of licence
28
(3) The Commission must not issue a group employer licence unless
29
the Commission is satisfied that it is appropriate to do so.
30
(4) In order for the Commission to be satisfied, for the purposes of
31
subsection (3), that it is appropriate to issue a group employer
32
licence, the Commission must be satisfied that:
33

(a) assuming that the covered corporations were a single body
1
corporate, that body corporate would have sufficient
2
resources to fulfil the responsibilities imposed on those
3
corporations as a result of being covered by the licence; and
4
(b) each nominated relevant authority has the capacity to ensure
5
(where the scope of the licence so provides) that claims that
6
are to be managed either:
7
(i) by the nominated relevant authority; or
8
(ii) by another person identified in the licence on the
9
nominated relevant authority's behalf;
10
will be managed in accordance with standards set by the
11
Commission for the management of claims; and
12
(c) the issue of the licence will not be contrary to the interests of
13
the employees of a covered corporation whose affairs fall
14
within the scope of the licence; and
15
(d) each covered corporation has the capacity to meet the
16
standards set by the Commission for the rehabilitation of the
17
corporation's employees; and
18
(e) each covered corporation has the capacity to meet the
19
standards set by the Commission for the occupational health
20
and safety of the corporation's employees.
21
(5) The Commission must not issue a group employer licence if:
22
(a) because of the past conduct of a proposed covered
23
corporation (including the corporation's performance in
24
meeting obligations in relation to rehabilitation under the law
25
of the Commonwealth or of a State or Territory), the
26
Commission is satisfied that it is unlikely that the corporation
27
will, if the licence is issued, meet the standards set by the
28
Commission for the rehabilitation of the corporation's
29
employees; or
30
(b) because of the past conduct of a nominated relevant authority
31
(including the nominated relevant authority's performance in
32
meeting obligations in relation to claims management under
33
the law of the Commonwealth or of a State or Territory), the
34
Commission is satisfied that it is unlikely that the nominated
35
relevant authority will, if the licence is issued, manage claims
36
in accordance with the standards set by the Commission.
37
(6) The Commission must not issue a group employer licence unless:

(a) each corporation covered by the licence is a member of a
1
particular corporate group; and
2
(b) each body corporate in the group is a related body corporate
3
of the key body corporate for the licence; and
4
(c) the group is a national employer group; and
5
(d) each corporation covered by the licence is incorporated in
6
Australia.
7
(7) The Commission may refuse to issue a group employer licence if,
8
because of the past conduct of a proposed covered corporation
9
(including the corporation's performance in complying with the
10
law of the Commonwealth or of a State or Territory dealing with
11
occupational health and safety), the Commission is satisfied that it
12
is unlikely that the corporation will, if the licence is issued, meet
13
the standards set by the Commission for the occupational health
14
and safety of the corporation's employees.
15
Notification of issue of licence
16
(8) If the Commission decides to issue a group employer licence, the
17
Commission must give written notice of the decision to the
18
applicant.
19
Refusal
20
(9) If the Commission decides to refuse to issue a group employer
21
licence, the Commission must give written notice of the decision,
22
and the reasons for the decision, to the applicant.
23
(10) Subsection (9) does not prevent the Commission, with the written
24
consent of each of the proposed covered corporations, from issuing
25
a group employer licence having a different scope to the licence
26
sought by the applicant.
27
107E Duration of group employer licence
28
(1) A group employer licence:
29
(a) comes into force at the start of the day specified in the
30
licence (which must be later than the day on which the
31
licence is issued); and
32
(b) remains in force for the period specified in the licence.

(2) Subsection (1) has effect subject to sections 107W, 107X and
1
107Y (which deal with the extension, suspension and revocation of
2
group employer licences).

107F Coverage of group employer licence
4
(1) If an application for a group employer licence proposes that a
5
corporation be covered by the licence, the corporation must be
6
covered by the licence.
7
Exclusion of corporation
8
(2) Subsection (1) does not apply to a corporation if:
9
(a) assuming that the corporation had applied for a single
10
employer licence, the Commission would have refused to
11
grant that licence to the corporation on the grounds that the
12
Commission was not satisfied as to a matter set out in:
13
(i) a paragraph of subsection 104(2); or
14
(ii) a paragraph of subsection 104(2A); and
15
(b) the Commission decides that the licence should not cover the
16
corporation.
17
(3) If:
18
(a) an application for a group employer licence proposes that a
19
corporation be covered by the licence; and
20
(b) the Commission proposes to:
21
(i) issue the licence; and
22
(ii) decide that the licence should not cover one or more
23
corporations (the excluded corporations);
24
then:
25
(c) the Commission must give a written notice to the applicant:
26
(i) setting out the proposal; and
27
(ii) stating that, unless the proposed covered corporations
28
(other than the excluded corporations) inform the
29
Commission, within 5 working days after the receipt of
30
the notice, that they agree that the licence should not
31
cover the excluded corporations, the Commission will
32
refuse to issue the licence; and

(d) the Commission must not issue the licence unless the
1
proposed covered corporations (other than the excluded
2
corporations) have informed the Commission, within 5
3
working days after the receipt of the notice, that they agree
4
that the licence should not cover the excluded corporations.
5
(4) If:
6
(a) an application for a group employer licence proposes that a
7
corporation be covered by the licence; and
8
(b) the Commission issues the licence, but decides that the
9
licence should not cover the corporation;
10
the Commission must give written notice of the decision, and the
11
reasons for the decision, to the applicant.
12
Variation
13
(5) Subsection (1) does not apply if:
14
(a) a corporation becomes covered by a group employer licence
15
as a result of the variation of the licence; or
16
(b) a corporation ceases to be covered by a group employer
17
licence as a result of the variation of the licence; or
18
(c) a corporation ceases to be covered by a group employer
19
licence because the corporation ceases to be a related body
20
corporate of the key body corporate (see section 107Q).
21
107G Administration manager
22
(1) If:
23
(a) an application for a group employer licence nominates a
24
corporation to be the administration manager for the licence;
25
and
26
(b) the Commission issues the licence;
27
the licence must designate the corporation as the administration
28
manager for the licence.
29
(2) The Commission may refuse to issue a group employer licence if
30
the Commission is satisfied that it is not appropriate for the
31
nominated administration manager to become the administration
32
manager for the licence.

(3) If the Commission proposes to refuse to issue a group employer
1
licence on the grounds that the Commission is satisfied that it is not
2
appropriate for the nominated administration manager (the original
3
nominee) to become the administration manager for the licence:
4
(a) the Commission must, by written notice given to the
5
applicant:
6
(i) inform the applicant of the proposed refusal; and
7
(ii) invite the applicant to amend the application, within 5
8
working days after receipt of the notice, so that the
9
application nominates another proposed covered
10
corporation to be the administration manager for the
11
licence, instead of the original nominee; and
12
(b) if:
13
(i) the application is so amended; and
14
(ii) the nominee consents, in writing, to the nomination;
15
the Commission must proceed to consider the amended
16
application.
17
Variation
18
(4) Subsection (1) does not apply if:
19
(a) a corporation becomes the administration manager for a
20
group employer licence as a result of the variation of the
21
licence; or
22
(b) a corporation ceases to be the administration manager for a
23
group employer licence as a result of the variation of the
24
licence; or
25
(c) a corporation ceases to be covered by a group employer
26
licence because the corporation ceases to be a related body
27
corporate of the key body corporate (see section 107Q).

107H Relevant authority
29
(1) If:
30
(a) an application for a group employer licence nominates a
31
corporation to be a relevant authority for the licence; and
32
(b) the Commission issues the licence;
33
the licence must designate the corporation as a relevant authority
34
for the licence.

licence on the grounds that the Commission is satisfied that it is not
6
appropriate for a nominated relevant authority (the original
7
nominee) to become a relevant authority for the licence:
8
(a) the Commission must, by written notice given to the
9
applicant:
10
(i) inform the applicant of the proposed refusal; and
11
(ii) invite the applicant to amend the application, within 5
12
working days after receipt of the notice, so that the
13
application nominates another proposed covered
14
corporation to be a relevant authority for the licence,
15
instead of the original nominee; and
16
(b) if the application is so amended--the Commission must
17
proceed to consider the amended application.

(4) Subsection (1) does not apply if:

(a) a corporation becomes a relevant authority for a group
21
employer licence as a result of the variation of the licence; or

28
If:
29
(a) an application for a group employer licence nominates a body

corporate to be the key body corporate for the licence; and

(b) the Commission issues the licence;

the licence must designate the body corporate as the key body

corporate for the licence.

107K Corporation may have multiple roles
1
A corporation may be 2 or more of the following for a particular
2
group employer licence:
3
(a) the administration manager for the licence;
4
(b) a relevant authority for the licence;
5
(b) the key body corporate for the licence.
6
107L Scope and conditions of group employer licence
7
If the Commission issues a group employer licence, the
8
Commission must determine:
9
(a) in accordance with Division 3--the scope of the licence so
10
far as concerns the degree to which, and the circumstances in
11
which, a relevant authority may accept liability for
12
compensation; and
13
(b) in accordance with Division 4--the scope of the licence so
14
far as concerns the degree to which, and the circumstances in
15
which, a relevant authority is authorised to manage claims;
16
and
17
(c) in accordance with Division 5--the conditions (if any) to
18
which the licence is subject.
19
107M Group employer licence is not held
20
A group employer licence is not held by:
21
(a) the applicant for the licence; or
22
(b) any other person or persons.
23
107N Licence fees
24
(1) If a corporation is covered by a group employer licence throughout
25
a period (the relevant period) that consists of:
26
(a) the whole of a financial year; or
27
(b) a part of a financial year;
28
the corporation is liable, on 1 July next following that financial
29
year, to pay a licence fee in respect of being covered by the licence
30
throughout the relevant period.

(2) The amount of the licence fee is the amount the Commission
1
notifies in writing to the administration manager for the licence.
2
The amount notified must be the amount estimated by the
3
Commission to represent:
4
(a) that part of the cost incurred by the Commission and by
5
Comcare in carrying out their respective functions under this
6
Act (other than the function referred to in paragraph 69(ec))
7
during the relevant period that is reasonably referrable to the
8
corporation; and
9
(b) that part of the cost incurred (if any) by the Commission and
10
by Comcare in carrying out their respective functions under:
11
(i) the Work Health and Safety Act 2011; and
12
(ii) the Work Health and Safety (Transitional and
13
Consequential Provisions) Act 2011;
14
during the relevant period that is reasonably referrable to the
15
corporation.
16
(3) The fee is payable to Comcare within such period after it is notified
17
to the administration manager as the Commission determines.

107P Variation of group employer licence--corporation becomes
19
covered by licence
20
(1) If a group employer licence is in force, the administration manager
21
may apply to the Commission for a specified corporation to be
22
covered by the licence.
23
Form of application
24
(2) The application must:
25
(a) be in writing; and
26
(b) be in a form approved, in writing, by the Commission; and
27
(c) be accompanied by such information as is specified in the
28
legislative rules; and
29
(d) be accompanied by such documents as are specified in the
30
legislative rules; and
31
(e) be accompanied by the written consent of the specified
32
corporation to being covered by the licence; and

(3) The administration manager is liable to pay to Comcare, in respect

of the application, an application fee equal to the amount estimated

by the Commission to be the cost of considering the application.

(4) The Commission must give written notice to the administration
8
manager of the amount of the application fee, and:
9
(a) if the notice is given before the application is made--the
10
application fee is to accompany the application; or
11
(b) otherwise--the application fee is to be paid as soon as
12
practicable after the notice is given.
13
Withdrawal of application
14
(5) The applicant may withdraw the application at any time before a
15
decision is made on the application.

identified in the licence as covered corporations include the
7
specified corporation.

Criteria for variation of licence
9
(9) The Commission must not vary the group employer licence unless
10
the Commission is satisfied that:
11
(a) the specified corporation is a related body corporate of the
12
key body corporate for the licence; and
13
(b) assuming that:
14
(i) the licence did not exist; and
15
(ii) paragraph 107D(6)(c) had not been enacted; and
16
(iii) an application were to be made for a new group
17
employer licence that is expressed to cover the specified
18
corporation and the existing covered corporations;
19
the Commission would have issued the new group employer
20
licence.
21
Notification of variation of licence
22
(10) If the Commission decides to vary the group employer licence, the
23
Commission must give written notice of the decision to:
24
(a) the specified corporation; and
25
(b) the administration manager.
26
Refusal
27
(11) If the Commission decides to refuse to vary the group employer
28
licence, the Commission must give written notice of the decision,
29
and the reasons for the decision, to:
30
(a) the specified corporation; and
31
(b) the administration manager.

Commission must give written notice of the decision to the covered
11
corporation.

The legislative rules may empower the Commission to vary a

group employer licence, so long as:
29
(a) the covered corporations have consented, in writing, to the
30
variation; and
31
(b) the other conditions specified in those legislative rules are

satisfied.

(d) revoke the licence.

(2) If a relevant authority for a group employer licence is authorised to

manage claims, then, in respect of any particular claim that the
10
relevant authority is authorised to manage, any notice or claim
11
given or made under Part V after the licence comes into force is to
12
be given or made to the relevant authority.
13
(3) If a relevant authority for a group employer licence is authorised to
14
manage claims, any proceedings (including proceedings under
15
Part VI) that may be brought:
16
(a) in relation to a determination made, or taken to have been
17
made, by the relevant authority in managing such a claim; or
18
(b) in relation to any thing done, or taken to have been done, by
19
the relevant authority in managing such a claim;
20
must be brought against the relevant authority.
21
(4) If proceedings are brought against a relevant authority for a group
22
employer licence in accordance with subsection (3):
23
(a) the relevant authority must inform Comcare as soon as
24
practicable that the proceedings have been brought; and
25
(b) the court or tribunal before which the proceedings have been
26
brought must, on application by Comcare, join Comcare as a
27
party to the proceedings.
28
(5) An application by Comcare under subsection (4):
29
(a) may be made by filing a notice in the registry of the court or
30
tribunal concerned; and
31
(b) must be notified to the other parties to the proceedings by
32
serving on them a copy of the notice so filed.

(1) The Commission may, in issuing a group employer licence,

(2) Without limiting the matters the conditions may deal with, the

conditions may include:

(a) a condition that each covered corporation, and any person

acting on behalf of a covered corporation, will comply with

the requirements of this Act and any relevant directions given
17
by the Commission; and
18
(b) a condition that each covered corporation will pay such
19
licence fees and other fees as are calculated in such manner,
20
and payable at such times, as the Commission specifies; and
21
(c) a condition that each specified covered corporation will
22
maintain such funds, and in such form, as the Commission
23
directs for the purpose of enabling the due discharge of the
24
covered corporation's liability to pay:
25
(i) compensation and other amounts under this Act; or
26
(ii) so much of that liability as exceeds a specified amount;
27
and
28
(d) a condition that appropriate bank or other guarantees will be
29
obtained by each specified covered corporation for the due
30
discharge of the covered corporation's liability to pay:
31
(i) compensation and other amounts under this Act; or

(3) This section does not prevent each of the corporations covered by a
18
group employer licence from being specified in a condition
19
mentioned in paragraph (2)(c) or (d).

Variation of conditions
21
(4) At any time while a group employer licence is in force, the
22
Commission may, by written notice given to the administration
23
manager, vary the conditions to which the licence is subject.
24
(5) The notice must set out:
25
(a) the terms of the variation; and
26
(b) the date of effect of the variation (which must not be earlier
27
than the date of notification of the variation).

licence, a non-financial obligation imposed by or under this Act on

a relevant authority may be discharged by any of the relevant

authorities.

(4) For the purposes of subsection (1), if:

(a) an injury suffered by an employee of a corporation occurred
19
when the corporation was covered by the group employer
20
licence; and
21
(b) the injury resulted in the death of the employee; and
22
(c) the death occurred after the corporation ceased to be covered
23
by the licence;
24
the death is taken to have occurred when the corporation was
25
covered by the licence.

108L Extended meaning of relevant authority
27
(1) If:

(a) a group employer licence is in force; and
29
(b) a corporation has ceased to be covered by the licence; and

(c) either:

(i) injury, loss or damage suffered by; or

(2) For the purposes of subsection (1), if:

(a) an injury suffered by an employee of a corporation occurred
7
when the corporation was covered by the group employer
8
licence; and
9
(b) the injury resulted in the death of the employee; and
10
(c) the death occurred after the corporation ceased to be covered
11
by the licence;
12
the death is taken to have occurred when the corporation was
13
covered by the licence.

108M Notification of cessation of coverage under a group employer
15
licence
16
(1) If:
17
(a) a group employer licence is in force; and
18
(b) a covered corporation (the departing corporation) ceases to
19
be a related body corporate of the key body corporate; and
20
(c) the departing corporation is not the administration manager;
21
the administration manager must:
22
(d) notify the Commission, in writing, of the cessation; and
23
(e) do so within 5 working days after becoming aware of the
24
cessation.
25
(2) If:
26
(a) a group employer licence is in force; and
27
(b) a covered corporation (the departing corporation) ceases to
28
be a related body corporate of the key body corporate; and
29
(c) the departing corporation is the administration manager;
30
the covered corporations must:
31
(d) notify the Commission, in writing, of the cessation; and

108N Grandfathering of single employer licence--transition to

group employer licence
5
(1) If a corporation:
6
(a) is the licence holder of a single employer licence; and
7
(b) becomes covered by a group employer licence at a particular
8
time;
9
then:
10
(c) the single employer licence does not authorise the
11
corporation to accept liability to pay compensation and other
12
amounts under this Act in respect of:
13
(i) injury, loss or damage suffered by; or
14
(ii) the death of;
15
an employee of the corporation that occurred after that time;
16
and
17
(d) the single employer licence does not authorise the
18
corporation, or a person acting on the corporation's behalf, to
19
manage a claim made in respect of:
20
(i) injury, loss or damage suffered by; or
21
(ii) the death of;
22
an employee of the corporation that occurred after that time;
23
and
24
(e) the corporation is taken to continue to be the relevant
25
authority for the purposes of the application of this Act to:
26
(i) injury, loss or damage suffered by; or
27
(ii) the death of;
28
an employee of the corporation that occurred before that
29
time.
30
(2) The Commission may, by written notice given to the licence holder
31
of a single employer licence, vary the licence in order to ensure
32
that the licence complies with subsection (1).
33
(3) Subsection (1) has effect despite any other provision of this Act.
