The Parliament of Australia enacts:

1  Short title 

4 

 

  This Act may be cited as the Social Security (Administration) 

5 

Amendment (Consumer Lease Exclusion) Act 2015.

2  Commencement 

7 

 

(1)  Each provision of this Act specified in column 1 of the table 

8 

commences, or is taken to have commenced, in accordance with 

9 

column 2 of the table. Any other statement in column 2 has effect 

10 

according to its terms.

Insert:

consumer lease means a contract for the hire of goods by a natural 

7 

person or strata corporation under which that person or corporation 

8 

does not have a right or obligation to purchase the goods. 

9 

2  After paragraph 123TI(1)(c) 

10 

Insert: 

11 

 

(ca)  goods hired under a consumer lease where: 

12 

 

(i)  the goods are hired wholly or predominantly for 

13 

personal, domestic or household purposes; and 

14 

 

(ii)  a charge is or may be made for hiring the goods and the 

15 

charge together with any other amount payable under 

16 

the consumer lease exceeds the cash price of the goods; 

17 

and 

18 

 

(iii)  the lessor hires the goods in the course of a business of 

19 

hiring goods carried on in this jurisdiction or as part of 

20 

or incidentally to any other business of the lessor carried 

21 

on in this jurisdiction.
