The Parliament of Australia enacts:

1 Short title
5
This Act may be cited as the Social Security and Veterans'
6
Entitlements Legislation Amendment (Schooling Requirements) Act
7
2008.

This Act commences on the day on which it receives the Royal
10
Assent.

1 Subsection 3(1) (at the end of the definition of receiving)

has a meaning affected by section 3AA (which deals with the

suspension of payments under Part 3C (schooling
10
requirements) of the Social Security (Administration) Act

3AA Meaning of receiving affected by suspension of certain
15
schooling requirement payme nts
16
Scope
17
(1) This section applies for the purpose of construing references to a
18
person receiving payments (affected schooling requirement
19
payments) covered by subsection (2), if the references are in the
20
following provisions:
21
(a) section 50S of the Family Assistance Administration Act;
22
(b) clauses 1 and 38L of Schedule 1 to this Act;
23
(c) clause 7 of Schedule 2 to this Act.
24
(2) The affected schooling requirement payments are the following:
25
(a) a social security pension;
26
(b) a social security benefit;
27
(c) a service pension;
28
(d) income support supplement.
29
Note:
These payments are schooling requirement payments within the
30
meaning of the Social Security (Administration) Act 1999 (see
31
section 124D of that Act).

General rule--person taken to receive payment during suspension

(3) In this Act, subject to subsections (4) and (5):
2
receiving is taken to include a reference to a person being
3
prevented from receiving an affected schooling requirement
4
payment because the payment is suspended under Part 3C
5
(schooling requirements) of the Social Security (Administration)
6
Act 1999.

Note:
See also the definition of receiving in subsection 3(1), and subsections
8
3(8) and (9).

Exception--more than 13 weeks continuous suspension
10
(4) Subsection (3) does not apply in relation to the suspension of an
11
affected schooling requirement payment if the payment has been
12
suspended for a continuous period of more than 13 weeks.
13
(5) However, if the period of suspension referred to in subsection (4)
14
started in the income year preceding the income year in which the
15
13 weeks referred to in that subsection elapsed, that subsection
16
does not apply in relation to the suspension until the start of the
17
later income year.

37AA Grant of claim--schooling require ments
22
(1) Without limiting subsection 37(1), the Secretary must determine
23
that a claim for a schooling requirement payment is to be granted if
24
the Secretary is satisfied that:
25
(a) the person is qualified, or is expected to be qualified, for the
26
payment; and
27
(b) the payment would be payable if it were not for the
28
application of subsection 124G(1) or 124L(1).
29
(2) Subsection (1) does not apply to a schooling requirement payment
30
under the Veterans' Entitlements Act.

Note 1:
Schooling requirement payments are social security benefits, social

security pensions and certain payments under the Veterans'
2
Entitlements Act (see section 124D of this Act).

Note 2:
Section 124G and 124L provide that a schooling requirement payment
4
is not payable to a person if he or she fails to comp ly with an
5
enrolment notice or an attendance notice after the end of an initial
6
compliance period (unless he or she has a reasonable excuse or special
7
circumstances apply).

Note 3:
If the payment is suspended under section 124H or 124M (because of
9
the application of subsection 124G(1) or 124L(1)) on the day the
10
claim is granted, the start day for the payment is deferred until the
11
suspension ends (at the earliest) (see clause 5 of Schedule 2).

Part 3C--Schooling requirements

Division 1--General
26
124 Scope
27
(1) This Part applies to a person (a schooling requirement person) in
28
relation to another person (a child) at a particular time if:
29
(a) either of the following applies at that time in relation to a
30
schooling requirement payment:
31
(i) a claim by the person for the payment is being
32
determined (under this Act or the Veterans'
33
Entitlements Act);

(ii) a claim by the person for the payment has been granted,

and the payment has not been cancelled (under this Act
2
or the Veterans' Entitlements Act); and
3
(b) either:
4
(i) the child is a schooling requirement child of the person
5
at that time; or
6
(ii) the child was a schooling requirement child of the
7
person at any time within a period provided by the
8
schooling requirement determination before that time;
9
and
10
(c) the child is required, under a law of a State or Territory:
11
(i) to be enrolled at a school; or
12
(ii) to attend a school at times required under that law.
13
(2) If this Part stops applying to a person while the person's schooling
14
requirement payment is suspended under this Part, section 124J or
15
124N (each of which provides for when payments become payable
16
after suspension) applies as if:
17
(a) this Part continued to apply to the person; and
18
(b) the reconsideration day for the purposes of the relevant
19
section were the day on which this Part stopped applying;
20
and
21
(c) the Secretary were satisfied that subsection 124G(1) or
22
124L(1), as the case requires, no longer applied to the person
23
as at the reconsideration day.

124A Enrolment and attendance at school
25
In this Part:
26
attendance, at a school, includes attendance at a place, for the
27
purpose of schooling, that is acceptable under a law of a State or
28
Territory as an alternative to a requirement under that law to attend
29
a school.
30
enrolment, at a school, includes anything, for the purpose of
31
schooling, that is acceptable under a law of a State or Territory as
32
an alternative to a requirement under that law to enrol at a school.
33
person responsible, for the operation of a school, includes:
34

(a) a person responsible for schooling (or for the administration

of schooling) at a place, other than a school, to which the
2
definition of attendance applies; and
3
(b) a person responsible for schooling (or for the administration
4
of schooling) in relation to which alternative enrolment of a
5
kind mentioned in the definition of enrolment applies.

124B Schooling re quirement child
7
Schooling requirement child
8
(1) For the purposes of this Act, a person (the first person) is a
9
schooling requirement child of another person at a particular time
10
if:
11
(a) at that time, the first person is a dependent child of the other
12
person; or
13
(b) all of the following conditions are satisfied:
14
(i) that time occurs during a schooling requirement period;
15
(ii) under a family law order, or a registered parenting plan
16
or parenting plan (within the meaning of the Family
17
Law Act 1975), that is in force during the schooling
18
requirement period, the first person is supposed to live
19
or spend time with the other person;
20
(iii) assuming the family law order, registered parenting plan
21
or parenting plan were complied with during the
22
schooling requirement period, the first person would
23
have been in the other person's care for at least 14% of
24
that period.

Schooling requirement period
26
(2) For the purposes of subsection (1), a schooling requirement period
27
is a period worked out in accordance with the schooling
28
requirement determination.
29
(3) A period worked out under subsection (2) may be a recurring
30
period (for example, a fortnight).
31
(4) For the purposes of this section, it is immaterial whether a
32
schooling requirement period begins before or after the
33
commencement of this section.

Family law order
1
(5) In this section:
2
family law order has the same meaning as in section 123TC.

124C Schooling requirement determination
4
For the purposes of this Part, the Minister may, by legislative
5
instrument, make a determination (the schooling requirement
6
determination) relating to school enrolment and attendance.
7
124D Schooling requirement payments
8
In this Act:
9
schooling requirement payment means:
10
(a) a social security benefit; or
11
(b) a social security pension; or
12
(c) one of the following payments under the Veterans'
13
Entitlements Act:
14
(i) Defence Force Income Support Allowance;
15
(ii) income support supplement;
16
(iii) service pension.

124E Application to payments under the Veterans' Entitlements Act
18
(1) For the purposes of this Part, the provisions of this Act covered by
19
subsection (2) apply (to the extent mentioned in that subsection) in
20
relation to schooling requirement payments that are made under the
21
Veterans' Entitlements Act as if the payments were schooling
22
requirement payments that are social security payments.
23
(2) The provisions of this Act covered by this subsection are as
24
follows:
25
(a) Part 1 (which includes provisions relating to the application
26
of the Criminal Code and interpretation);
27
(b) section 85 and Division 9 of Part 3, to the extent that these
28
provisions relate to the cancellation of schooling requirement
29
payments under this Part;
30
Note:
These provisions deal with the reconsideration of decisions in
31
relation to social security payments.

(c) Division 10 of Part 3 (continuing effect of determinations), to
1
the extent that the Division relates to the suspension and
2
cancellation of schooling requirement payments under this
3
Part;
4
(d) Part 4 (review of decisions), to the extent that the Part relates
5
to the suspension and cancellation of schooling requirement
6
payments under this Part;
7
(e) Part 5 (information management), to the extent necessary or
8
convenient for the administration of this Part;
9
(f) Part 6 (offences), to the extent that the Part relates to acts or
10
omissions occurring in relation to the administration of this
11
Part;
12
(g) Part 7 (which includes provisions relating to delegations and
13
regulations etc.), to the extent necessary or convenient for the
14
administration of this Part;
15
(h) Schedule 1 (Dictionary).

Division 2--School enrolment

124F School enrolment--enrolment notices
18
Enrolment notices generally
19
(1) The Secretary may give a notice (an enrolment notice) to a
20
schooling requirement person about the person's child, requiring
21
the person to give the Secretary evidence (in accordance with the
22
notice) that the child is enrolled at a school as required by a law of
23
a State or Territory.
24
(2) Without limiting subsection (1), an enrolment notice may require
25
evidence of enrolment to be given in the form of a written or oral
26
statement by the schooling requirement person, or another person,
27
confirming enrolment.
28
(3) The enrolment notice must give details of:
29
(a) how to comply with the notice; and
30
(b) the initial period for compliance with the notice, and the
31
Secretary's power to extend that period (see subsections (4)
32
and (5)); and
33
(c) the consequences under this Division of not complying with
34
the notice.

Initial period for compliance
1
(4) The enrolment notice must state an initial period for compliance
2
with the notice of at least 14 days after the notice is given.
3
(5) The Secretary may extend the initial period for compliance stated
4
in the enrolment notice before or after the end of the stated period.

124G School enrolme nt--condition of schooling require ment
6
payments
7
(1) A schooling requirement payment is not payable to a schooling
8
requirement person if the person fails to comply with an enrolment
9
notice given to the person under section 124F.
10
(2) Subsection (1) does not apply to the schooling requirement person
11
in relation to an enrolment notice, as at a particular day, if:
12
(a) the initial compliance period stated in the notice (as
13
extended, if at all, under subsection 124F(5)) has not ended at
14
that day; or
15
(b) the Secretary is satisfied that:
16
(i) as at that day, the person has a reasonable excuse, as
17
determined in accordance with the schooling
18
requirement determination (if any), for failing to comply
19
with the enrolment notice; or
20
(ii) in the special circumstances of the case applying as at
21
that day, as determined in accordance with the
22
schooling requirement determination (if any), it is
23
appropriate that the subsection should not apply as at
24
that day.
25
(3) A schooling requirement payment cannot be suspended, or
26
cancelled, because of the application of subsection (1) except as
27
provided by section 124H.
28
(4) For a schooling requirement payment under the Veterans'
29
Entitlements Act:
30
(a) this section does not apply in relation to the grant of the
31
payment; but
32
(b) this section otherwise applies in relation to the payment.

124H School enrolme nt--suspension or cancellation for

non-compliance with enrolme nt notice
2
Scope
3
(1) This section applies if, as at a particular day:
4
(a) a schooling requirement person has been given an enrolment
5
notice; and
6
(b) a schooling requirement payment is not payable to the person
7
because subsection 124G(1) applies to the person as at that
8
day.
9
Note:
Section 124G provides that a schooling requirement payment is
10
not payable to a person if he or she fails to comply with an
11
enrolment notice after the end of the initial compliance period
12
(unless he or she has a reasonable excuse or special
13
circumstances apply).

Suspension or cancellation of payment
15
(2) The Secretary must:
16
(a) if the payment has been suspended under this section for a
17
total period of 13 weeks or more (which need not be a
18
continuous period) in relation to compliance with the
19
enrolment notice--determine that the payment is to be
20
suspended or cancelled; or
21
(b) in any other case--determine that the payment is to be
22
suspended.

Payment may be suspended more than once
24
(3) The Secretary may make more than one determination under
25
subsection (2) in relation to compliance with a particular enrolment
26
notice.

Note:
Following suspension of a schooling requirement payment, the
28
payment may become payable again under section 124J. Subsection
29
124H(3) allows for a further suspension of the payment even after the
30
payment has become payable again.

Payment may be suspended even if not yet received

(4) The Secretary may suspend a schooling requirement person's
33
schooling requirement payment under this section even if the
34
person has not started to receive the payment.

Note:
An enrolment notice may be given to a claimant for a schooling
1
requirement payment (see section 124 (Scope)). The claim may be
2
granted even if subsection 124G(1) applies to the person. However, in
3
that event, the Secretary must suspend the payment under this section
4
(before it has started).

124J School enrolment--when payments become payable after
6
suspension
7
Scope
8
(1) This section applies if, on a particular day (the reconsideration
9
day):
10
(a) a person's schooling requirement payment has been, and
11
remains, suspended under section 124H; and
12
(b) the Secretary has reconsidered the decision to suspend the
13
payment (whether on an application under section 129 or on
14
his or her own initiative); and
15
(c) as a result of the reconsideration, the Secretary is satisfied
16
that, as at the reconsideration day, subsection 124G(1) no
17
longer applies to the person.

Note 1:
The cancellation of a schooling requirement payment may be
19
reconsidered under section 85.
20
Note 2:
Section 124G provides that a schooling requirement payment is not
21
payable to a person if he or she fails to comply with an enrolment
22
notice after the end of an initial compliance period (unless he or she
23
has a reasonable excuse or special circumstances apply).

Determination that payment is payable
25
(2) The Secretary must determine:
26
(a) that the schooling requirement payment is payable to the
27
schooling requirement person (subject to any other provision
28
of the social security law or the Veterans' Entitlements Act,
29
as the case requires); and
30
(b) that any arrears resulting from the operation of this section
31
are to be paid at a time, or times, stated in the determination
32
under this subsection (or worked out in accordance with that
33
determination).

Entitlement to arrears--suspension for total period of up to 13
1
weeks
2
(3) If the payment has been suspended under section 124H for a total
3
period of less than 13 weeks (which need not be a continuous
4
period) in relation to compliance with a particular enrolment
5
notice, the date of effect of the determination under subsection (2)
6
is the day on which the latest suspension determination was made
7
under section 124H in relation to such compliance.
8
Note:
A schooling requirement payment may be suspended more than once
9
under section 124H (see subsection 124H(3)).

Entitlement to arrears--suspension for total period of 13 weeks or
11
more
12
(4) If subsection (3) does not apply, the date of effect of the
13
determination under subsection (2) is:
14
(a) the reconsideration day; or
15
(b) an earlier day stated by the Secretary in that determination to
16
be appropriate, in the special circumstances of the case
17
applying as at the reconsideration day, as determined in
18
accordance with the schooling requirement determination (if
19
any).
20
(5) For the purposes of subsection (4), the Secretary may vary a
21
determination under subsection (2) to state an earlier date of effect,
22
if the determination:
23
(a) does not include such a statement; or
24
(b) includes such a statement in relation to a later day.
25
How arrears are paid
26
(6) Arrears resulting from the operation of this section may be paid to
27
the person as a lump sum payment, a series of regular payments, or
28
otherwise, as provided by the determination under subsection (2).
29
(7) The person is entitled to a payment, or payments, of arrears arising
30
from the operation of this section at the time, or times, provided by
31
the determination under subsection (2).

Non-application of general provisions for date of effect

(8) Division 9 of Part 3 (date of effect of determinations) does not
2
apply in relation to a determination under subsection (2).

Division 3--School attendance

124K School attendance--attendance notices
5
Scope
6
(1) This section applies if:
7
(a) a schooling requirement person's child is enrolled at a school
8
in a State or Territory; and
9
(b) a person responsible for the operation of the school gives the
10
Secretary written notice that:
11
(i) the child is failing to attend school, as required by the
12
law of that State or Territory, to the satisfaction of the
13
person responsible; and
14
(ii) the schooling requirement person is failing to take
15
reasonable steps to ensure that the child attends school,
16
as required by the law of that State or Territory, to the
17
satisfaction of the person responsible.

Attendance notice
19
(2) The Secretary may give a notice (an attendance notice) to the
20
schooling requirement person, requiring the person to take
21
reasonable steps, as determined in accordance with the schooling
22
requirement determination (if any), to ensure that the child attends
23
school as required by the law of that State or Territory.
24
(3) The attendance notice must give details of:
25
(a) how to comply with the notice; and
26
(b) the initial period for compliance with the notice, and the
27
Secretary's power to extend that period (under
28
subsections (4) and (5)); and
29
(c) the consequences under this Division of not complying with
30
the notice.

Initial period for compliance
1
(4) The attendance notice must state an initial period for compliance
2
with the notice of at least 28 days after the notice is given.
3
(5) The Secretary may extend the initial period for compliance stated
4
in the attendance notice before or after the end of the stated period.

124L School attendance--condition of schooling requirement
6
payments
7
(1) A schooling requirement payment is not payable to a schooling
8
requirement person if the person fails to comply with an attendance
9
notice given to the person under section 124K.
10
(2) Subsection (1) does not apply to the schooling requirement person
11
in relation to an attendance notice, as at a particular day, if:
12
(a) the initial compliance period stated in the notice (as
13
extended, if at all, under subsection 124K(5)) has not ended
14
at that day; or
15
(b) the Secretary is satisfied that:
16
(i) as at that day, the person has a reasonable excuse, as
17
determined in accordance with the schooling
18
requirement determination (if any), for failing to comply
19
with the attendance notice; or
20
(ii) in the special circumstances of the case applying as at
21
that day, as determined in accordance with the
22
schooling requirement determination (if any), it is
23
appropriate that the subsection should not apply as at
24
that day.
25
(3) A schooling requirement payment cannot be suspended, or
26
cancelled, because of the application of subsection (1) except as
27
provided by section 124M.
28
(4) For a schooling requirement payment under the Veterans'
29
Entitlements Act:
30
(a) this section does not apply in relation to the grant of the
31
payment; but
32
(b) this section otherwise applies in relation to the payment.

Scope

(1) This section applies if, as at a particular day:
4
(a) a schooling requirement person has been given an attendance
5
notice; and
6
(b) a schooling requirement payment is not payable to the person
7
because subsection 124L(1) applies to the person as at that
8
day.

Note:
Section 124L provides that a schooling requirement payment is not
10
payable to a person if he or she fails to comply with an attendance
11
notice after the end of the initial compliance period (unless he or she
12
has a reasonable excuse or special circumstances apply).
13
Suspension or cancellation of payment
14
(2) The Secretary must:
15
(a) if the payment has been suspended under this section for a
16
total period of 13 weeks or more (which need not be a
17
continuous period) in relation to compliance with the
18
attendance notice--determine that the payment is to be
19
suspended or cancelled; or
20
(b) in any other case--determine that the payment is to be
21
suspended.

Note:
An attendance notice may be given to a claimant for a schooling

requirement payment (see section 124 (Scope)). The claim may be
2
granted even if subsection 124L(1) applies to the person. However, in
3
that event, the Secretary must suspend the payment under this section
4
(before it has started).

124N School attendance--when payments become payable after
6
suspension
7
Scope
8
(1) This section applies if, on a particular day (the reconsideration
9
day):
10
(a) a person's schooling requirement payment has been, and
11
remains, suspended under section 124M; and
12
(b) a person responsible for the operation of a school in a State
13
or Territory at which the person's child is enrolled gives the
14
Secretary written notice that the child is attending school, as
15
required by the law of that State or Territory, to the
16
satisfaction of the person responsible.
17
(2) This section also applies if, on a particular day (the
18
reconsideration day):
19
(a) a person's schooling requirement payment has been, and
20
remains, suspended under section 124M; and
21
(b) the Secretary has reconsidered the decision to suspend the
22
payment (whether on an application under section 129 or on
23
his or her own initiative); and
24
(c) as a result of the reconsideration, the Secretary is satisfied
25
that, as at the reconsideration day, subsection 124L(1) no
26
longer applies to the person.

Note 1:
The cancellation of a schooling requirement payment may be
28
reconsidered under section 85.

Note 2:
Section 124L provides that a schooling requirement payment is not
30
payable to a person if he or she fails to comply with an attendance
31
notice after the end of an initial compliance period (unless he or she
32
has a reasonable excuse or special circumstances apply).

Determination that payment is payable
34
(3) The Secretary must determine:
35
(a) that the schooling requirement payment is payable to the
36
schooling requirement person (subject to any other provision

of the social security law or the Veterans' Entitlements Act,

as the case requires); and
2
(b) that any arrears resulting from the operation of this section
3
are to be paid at a time, or times, stated in the determination
4
under this subsection (or worked out in accordance with that
5
determination).

Entitlement to arrears--suspension for total period of up to 13
7
weeks
8
(4) If the payment has been suspended under section 124M for a total
9
period of less than 13 weeks (which need not be a continuous
10
period) in relation to compliance with a particular attendance
11
notice, the date of effect of the determination under subsection (3)
12
is the day on which the latest suspension determination was made
13
under section 124M in relation to such compliance.

Note:
A schooling requirement payment may be suspended more than once
15
under section 124M (see subsection 124M(3)).

Entitlement to arrears--suspension for total period of 13 weeks or
17
more
18
(5) If subsection (4) does not apply, the date of effect of the
19
determination under subsection (3) is:
20
(a) the reconsideration day; or
21
(b) an earlier day stated by the Secretary in that determination to
22
be appropriate, in the special circumstances of the case
23
applying as at the reconsideration day, as determined in
24
accordance with the schooling requirement determination (if
25
any).

(6) For the purposes of subsection (5), the Secretary may vary a
27
determination under subsection (3) to state an earlier date of effect,
28
if the determination:
29
(a) does not include such a statement; or
30
(b) includes such a statement in relation to a later day.

How arrears are paid
32
(7) Arrears resulting from the operation of this section may be paid to
33
the person as a lump sum payment, a series of regular payments, or

otherwise, in accordance with the determination under

subsection (3).

(8) The person is entitled to a payment, or payments, of arrears arising
3
from the operation of this section at the time, or times, provided by
4
the determination under subsection (3).

Non-application of general provisions for date of effect
6
(9) Division 9 of Part 3 (date of effect of determinations) does not
7
apply in relation to a determination under subsection (3).

Division 4--Information about schooling

124P Schooling require ments--information about schooling

(1) Despite any law (whether written or unwritten) in force in a State
11
or Territory:
12
(a) a State or Territory; or
13
(b) a non-government school authority; or
14
(c) any other person who is responsible for the operation of one
15
or more schools;
16
may, for the purposes of this Part, give the Secretary information
17
about the enrolment, or non-enrolment, of children at school.
18
(2) Despite any law (whether written or unwritten) in force in a State
19
or Territory:
20
(a) a State or Territory; or
21
(b) a non-government school authority; or
22
(c) any other person who is responsible for the operation of one
23
or more schools;
24
may, for the purposes of this Part, give the Secretary information
25
about the attendance, or non-attendance, of children at school.

(8) If a person does something under subsection (6) for the purposes of

Part 3C (schooling requirements), in subsection (6) or (7) of this
25
section the following terms have the same meaning as in Part 3C
26
(see section 124A):

(a) attendance (at a school);

(b) enrolment (at a school);
29
(c) person responsible (for the operation of a school).
