The Parliament of Australia enacts:

1 Short title

This Act is the
Social Services Legislation Amendment (Consistent
6
Waiting Periods for New Migrants) Act 2021
.

2 Commencement
8
(1) Each provision of this Act specified in column 1 of the table
9
commences, or is taken to have commenced, in accordance with
10
column 2 of the table. Any other statement in column 2 has effect
11
according to its terms.

As follows:
(a) if this Act receives the Royal Assent on
or before 3 December 2021--1 January

after 3 December 2021--the first
1 January or 1 July to occur after the end
of the period of 1 month beginning on
the day this Act receives the Royal
Assent.

Immediately after the commencement of
Schedule 1 to the
Social Security Legislation
Amendment (Streamlined Participation
Requirements and Other Measures) Act
2021
.
However, the provision does not commence
at all if that Schedule commences before the
day on which the provisions covered by
table item 2 commence.

and 3
As follows:
(a) if this Act receives the Royal Assent on
or before 3 December 2021--1 January
2022;
(b) if this Act receives the Royal Assent
after 3 December 2021--the first
1 January or 1 July to occur after the end
of the period of 1 month beginning on
the day this Act receives the Royal
Assent.

17 Application provisions

(1)
The amendments of sections 201AA, 201AB, 966 and 967 of the
Social

Security Act 1991
made by this Part apply in relation to a person who
3
becomes the holder of a permanent visa on or after the commencement
4
of this item.
5
(2)
However, the amendments of sections 201AA and 201AB of the
Social
6
Security Act 1991
made by this Part do not apply in relation to a person
7
who, on or after the commencement of this item, becomes the holder of:
8
(a) a visa referred to in the regulations under the
Migration Act
9
1958
as a Subclass 117 (Orphan Relative) visa or as a
10
Subclass 837 (Orphan Relative) visa; or
11
(b) a visa referred to in the regulations under the
Migration Act
12
1958
as a Subclass 115 (Remaining Relative) visa or as a
13
Subclass 835 (Remaining Relative) visa.

(3)
The amendments of section 500 of the
Social Security Act 1991
made
15
by this Part apply in relation to claims for parenting payment made on
16
or after the commencement of this item.
17
(4)
The amendments made by this Part do not apply in relation to a special
18
category visa holder who is a protected SCV holder.
19
(5)
If, on or after the commencement of this item, a person becomes the
20
holder of a special category visa for the first time, then, subject to
21
subitem 21(6) of Schedule 1 to the
Social Services and Other
22
Legislation Amendment (Promoting Sustainable Welfare) Act 2018
, the
23
amendments of sections 1061ZH, 1061ZI, 1061ZQ and 1061ZR of the
24
Social Security Act 1991
made by Part 1 of that Schedule apply in
25
relation to the person.

(6)
If, on or after the commencement of this item, a person is granted for
27
the first time a visa that is in a class of visas determined by the Minister
28
for the purposes of paragraph 739A(3)(b) of the
Social Security Act
29
1991
, then the amendments of section 1061ZR of that Act
made by
30
Part 1 of Schedule 1 to the
Social Services and Other Legislation

Amendment (Promoting Sustainable Welfare) Act 2018
apply in relation

to the person.
