The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Water Amendment (Review
5
Implementation and Other Measures) Act 2015.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

52A Annual analysis of Basin Plan's effectiveness

(1) The Authority must, after the end of each financial year, cause an
3
analysis of the Basin Plan's effectiveness to be conducted.
4
(2) The Authority must prepare and give to the Minister a written
5
report of the analysis within 6 months after the end of the financial
6
year.

(3) The Minister must cause a copy of the report to be tabled in each
8
House of the Parliament within 15 sitting days of that House after
9
the Minister receives the report.
10
(4) A copy of the report must also be given to each other member of
11
the Murray-Darling Basin Ministerial Council.

commencement of this Part.

(1) The Commonwealth Environmental Water Holder may only

dispose of water or Commonwealth environmental water holdings

in accordance with subsection (2) or (3).

Water or holdings that cannot be carried over, or that are likely to
14
result in a reduced allocation
15
(2) The Commonwealth Environmental Water Holder may dispose of
16
water or Commonwealth environmental water holdings during a
17
water accounting period if he or she reasonably believes that:
18
(a) the water or the water holdings are not required in the water
19
accounting period to meet the objectives of:
20
(i) if the water is in, or the water holdings relate to water
21
in, the Murray-Darling Basin--the environmental
22
watering plan; or
23
(ii) if the water is in, or the water holdings relate to water
24
in, an area outside the Murray-Darling Basin--any
25
plans specified in the regulations in relation to that area;
26
or
27
(iii) any applicable environmental watering schedules; and
28
(b) either:

(i) the water or the water holdings cannot be carried over

occur.

Proceeds of disposal used for new acquisitions or environmental
7
activities
8
(3) The Commonwealth Environmental Water Holder may dispose of
9
water or Commonwealth environmental water holdings if:
10
(a) the Commonwealth Environmental Water Holder uses the
11
proceeds of the disposal for either or both of the following
12
activities:
13
(i) acquiring water or Commonwealth environmental water
14
holdings;
15
(ii) for a disposal of a water allocation--environmental
16
activities; and
17
(b) if the disposal is of a water allocation and any of the proceeds
18
of the disposal are used for environmental activities--the
19
long-term annual diversion limit condition is satisfied in
20
relation to the disposal (see subsections (5) and (6)); and
21
(c) in any case--the Commonwealth Environmental Water
22
Holder reasonably believes, at the time of the disposal, that
23
using the proceeds for activities of the kind mentioned in
24
subparagraph (a)(i) or (ii) (if applicable) would improve the
25
capacity of the Commonwealth environmental water holdings
26
to be applied to meet the objectives of one or more of the
27
following:
28
(i) the environmental watering plan;
29
(ii) a plan specified in the regulations in relation to an area
30
outside the Murray-Darling Basin;
31
(iii) protecting or restoring the environmental assets of an
32
area outside the Murray-Darling Basin in relation to
33
which those regulations do not specify a plan.

Paragraph (c) is modified in relation to water access rights acquired by
35
the Commonwealth with amounts debited from the Water for the
36
Environment Special Account (see subsection 86AE(2)).

(4) For the purposes of subparagraph (3)(a)(ii) and paragraph (3)(b),

environmental activities do not include paying a fee or charge of
2
the kind referred to in paragraph 91(1)(a), (b) or (c), or
3
subparagraph 91(1)(d)(i), (ii), (iii) or (iv), in relation to
4
Commonwealth environmental water holdings.

Section 91 is about regulated water charges.

(5) For the purposes of paragraph (3)(b), the long-term annual
7
diversion limit condition is satisfied in relation to a disposal of a
8
water allocation if:
9
(a) before the disposal, the Authority had published information
10
indicating whether the long-term annual diversion limit had
11
been complied with for a water accounting period for the part
12
of the water resources of the water resource plan area to
13
which the water allocation relates; and
14
(b) the Commonwealth Environmental Water Holder is satisfied,
15
at the time of the disposal and on the basis of information
16
published as mentioned in paragraph (a), that, for the most
17
recent water accounting period for which such information
18
had been published, the limit had been complied with for that
19
part of those water resources.
20
(6) The long-term annual diversion limit condition is also satisfied in
21
relation to a disposal of a water allocation if the Authority had not
22
published information of the kind mentioned in paragraph (5)(a)
23
before the disposal for any water accounting period.
