2011 The Parliament of the Commonwealth of Australia The Senate Environment Protection and Biodiversity Conservation Amendment (Bioregional Plans) Bill 2011 Explanatory Memorandum Circulated by authority of Senator Richard Colbeck, TasmaniaOutline: The Environment Protection and Biodiversity Conservation Amendment (Bioregional Plans) Bill 2011 seeks to make bioregional plans disallowable instruments, as per the provisions in the Legislative Instruments Act 2003. Under the current provisions for bioregional plans within the Environment Protection and Biodiversity Conservation Act , a bioregional plan as prepared under subsection (1) or (2) is not a legislative instrument. As such, the Minister for Environment currently has sole power to approve the adoption of bioregional plans. The Environment Protection and Biodiversity Conservation Amendment (Bioregional Plans) Bill 2011 seeks to remove the absolute power of the Minister with respect to bioregional plans and to provide Parliament the opportunity to oversight in the bioregional plan process.
