NATIONAL MEASUREMENT AMENDMENT
BILL 1998
OUTLINE
This
Bill will
(a) remove a drafting error in the
National Measurement Act 1960 ("the Act") whereby certifying bodies for
the certification of regulatory measurements made, for example by the police,
must be created under the National Measurement Regulations and existing bodies
cannot be appointed.
(b) remove, in
accordance with government policy, the requirement for the Executive Director
of the National Standards Commission to retire upon reaching the age of
65.
FINANCIAL IMPACT
STATEMENT
The removal of the drafting
error in (a) will allow the making of amendments to the National Measurement
Regulations which will allow the compliance of regulatory measurements with the
provisions of the Act to be simply demonstrated. This will greatly reduce
disputation costs associated with regulatory measurements although the extent of
this reduction is impossible to
quantify.
The removal of the mandatory
retirement age for the Executive Director of the National Standards Commission
will have no financial impact.

CLAUSES
Clause 1: Short

Provides for the proposed Act to be
cited as the National Measurement Amendment Act
1998.

Provides for the proposed Act
to come into operation on the day it receives royal
assent
Clause 3:
Schedules
Proposed clause 3 provides that
each Act that is specified in a schedule to this Bill is amended or repealed as
set out in the proposed applicable items in the Schedule concerned, and any
other proposed item in a Schedule to this Bill has effect according to its
terms.
Schedule 1 - Amendment of
National Measurement Act 1960
Item
1 This proposed item amends the definition of a certified measuring instrument
by removing the reference to a “certifying
body”.
Item 2 This proposed item
amends the definition of certified reference material by removing the reference
to a “certifying body”.
Item
3 This proposed item removes the definition of a “certifying
body”.
Item 4 This proposed item
repeals the requirement contained in subsection 18AJ(2) for the Executive
Director of the National Standards Commission to retire upon reaching 65 years
of age.
Item 5 This proposed item amends
paragraph 20(e) so that in effect it becomes the last paragraph of section
20.
Item 6 This proposed item removes
paragraph 20(f), which provided a regulation making power relating to the
establishment of certifying bodies, and which was previously the last paragraph
of section 20.
