NATIONAL RESIDUE SURVEY (RATITE SLAUGHTER) LEVY BILL
1997
GENERAL OUTLINE
1. The purpose of this Bill is to enable a
National Residue Survey (NRS)
levy to be introduced on Ratites. Ratites are
members of the avian order
of large flightless vertebrates that have a flat
sternum. This order
includes the Ostrich of Africa, the Emu and Cassowary
of Australia, the
Rhea of South America and the Kiwi of New
Zealand.
2. This Bill allows for a NRS levy of seventy five cents per
bird slaughtered
to be put in place, at the request of Emu Farmers
Federation of Australia,
on the slaughter of the ratite emu for human
consumption. This will
allow for long-term flexibility for the emu industry
in determining the
cost of chemical residue programs, thus allowing access
to all and any
export and domestic market for emu meat
product.
3. The functions of the NRS are to monitor and assess the levels
of chemical
residues in raw plant and animal commodities and to give
domestic and
international consumers confidence in the quality and safety of
those
products
FINANCIAL IMPACT STATEMENT
4. The proposed levy
have no financial implications for the Commonwealth
as the levy is at the
initiative of the Emu Farmers Federation of Australia.
NOTES
ON CLAUSES
Clause 1: Short Title etc.
5. Provides for the Act to
be called the National Residue Survey (Ratite
Slaughter) Levy Act
1997.
Clause 2: Commencement
6. Provides for the Act to come into
effect on 1 July 1997.
Clause 3: Act binds Crown
7. Provides for
the Act to apply in all the Australian states, the Australian
Capital
Territory, the Northern Territory and Norfolk Island.
Clause 4:
Interpretation
8. For the purpose of interpreting the Act provides for a
definition of ratite
and for words and expressions to be interpreted in the
same way as in
the Primary Industries Levies and Charges Collection Act
1991.
Clause 5: Imposition
9. Imposes the National Survey Levy on
the slaughter at an abattoir of
ratites intended for human
consumption.
Clause 6: Rate of levy
10. Sets the operative rate of
levy for the ratite emu to be $0.75 per head,
unless another rate is
prescribed by a regulation for the ratite emu
and/or any other ratite, and
sets the maximum rate that can be
prescribed under regulation at $5.00 per
head.
Clause 7: Who pays the levy
11. Provides for the levy to be
paid by the person who owns the bird at the
time of slaughter.

12. Provides for the making of regulations that are
authorised by the Act or
are needed to allow the Act to
operate.
