2013 THE PARLIAMENT OF THE COMMONWEALTH OF AUSTRALIA HOUSE OF REPRESENTATIVES OFFSHORE PETROLEUM AND GREENHOUSE GAS STORAGE (REGULATORY LEVIES) AMENDMENT BILL 2013 EXPLANATORY MEMORANDUM (Circulated by authority of the Minister for Industry, the Honourable Ian Macfarlane, MP)OFFSHORE PETROLEUM AND GREENHOUSE GAS STORAGE (REGULATORY LEVIES) AMENDMENT BILL 2013 OUTLINE The purpose of this Bill is to amend the Offshore Petroleum and Greenhouse Gas Storage (Regulatory Levies) Act 2003 (the Act) to provide for the annual titles administration levy to be collected by the National Offshore Petroleum Titles Administrator in relation to cash bid petroleum exploration permits in the offshore regulatory regime. The Australian Government confirmed in October 2013 the decision to apply the cash bidding title allocation method for select blocks released in the 2014 Offshore Petroleum Exploration Acreage Release. Amendments are being made through the Offshore Petroleum and Greenhouse Gas Storage Amendment (Cash Bidding) Bill 2013 to the Offshore Petroleum and Greenhouse Gas Storage Act 2006 to optimise the allocation method for cash bid petroleum exploration permits. This Bill makes consequential amendments as required to the Act to allow for the full ongoing cost recovery of the National Offshore Petroleum Titles Administrator. FINANCIAL IMPACT STATEMENT The Bill has no financial impact. 1
STATEMENT OF COMPATIBILITY WITH HUMAN RIGHTS Prepared in accordance with Part 3 of the Human Rights (Parliamentary Scrutiny) Act 2011 This Bill is compatible with the human rights and freedoms recognised or declared in the international instruments listed in section 3 of the Human Rights (Parliamentary Scrutiny) Act 2011. Overview of the Bill The Bill makes amendments to the Act to provide the ability for the National Offshore Petroleum Titles Administrator to collect an annual titles administration levy in relation to cash bid petroleum exploration permits in the offshore regulatory regime. Human rights implications This Bill does not engage any of the applicable rights or freedoms. Conclusion This Bill is compatible with human rights as it does not raise any human rights issues. 2
OFFSHORE PETROLEUM AND GREENHOUSE GAS STORAGE (REGULATORY LEVIES) AMENDMENT BILL 2013 NOTES ON CLAUSES Clause 1: Short title Clause 1 is a formal provision specifying the short title of the Act. Clause 2: Commencement Sections 1-3 will commence on the day after this Act receives the Royal Assent, with Schedule 1 commencing at the same time that the Offshore Petroleum and Greenhouse Gas Storage (Cash Bidding) Amendment Act 2013 commences. Clause 3: Schedule(s) This clause gives effect to the provisions in the Schedule to this Act. 3
Schedule 1 Items 1 and 2: Subsection 10E(7) and subsection 10E(7) (after paragraph (a) of the definition of eligible title) This items make amendments to provide the ability for the National Offshore Petroleum Titles Administrator to collect an annual titles administration levy in relation to cash bid petroleum exploration permits. 4
