2013-2014-2015 THE PARLIAMENT OF THE COMMONWEALTH OF AUSTRALIA HOUSE OF REPRESENTATIVES PUBLIC GOVERNANCE AND RESOURCES LEGISLATION AMENDMENT BILL (NO. 1) 2015 SUPPLEMENTARY EXPLANATORY MEMORANDUM Amendments to be moved on behalf of the Government (Circulated by authority of the Minister for Finance, Senator the Hon Mathias Cormann)Index] [Search] [Download] [Bill] [Help]AMENDMENTS TO THE PUBLIC GOVERNANCE AND RESOURCES LEGISLATION AMENDMENT BILL (NO. 1) 2015 GENERAL OUTLINE The Public Governance and Resources Legislation Amendment Bill (No. 1) 2015 (the Bill) was introduced in the House of Representatives on 12 February 2015. The amendments to the Bill will amend the Parliamentary Superannuation Act 2004 to enable parliamentarians who are covered by that Act to direct their superannuation contributions to self managed superannuation funds. The amendments will also amend the Remuneration and Allowances Act 1990 to allow salary sacrificing to self managed superannuation funds. The restriction on salary sacrificing to self managed superannuation funds was a consequence of the general restriction on superannuation contributions being made into self managed superannuation funds and will no longer be relevant. FINANCIAL IMPACT STATEMENT The amendments to the Bill have no financial impact. STATEMENT OF COMPATIBILITY WITH HUMAN RIGHTS The amendments to the Bill, if enacted, will not affect any of the applicable rights or freedoms outlined in the Human Rights (Parliamentary Scrutiny) Act 2011. The amendments are therefore compatible with the human rights and freedoms recognised or declared in the international instruments listed in subsection 3(1) of the Human Rights (Parliamentary Scrutiny) Act 2011. NOTES ON AMENDMENTS Amendments 1 to 4 remove restrictions in the Parliamentary Superannuation Act 2004 on parliamentarians directing their superannuation contributions to self managed superannuation funds. Amendments 5 to 8 remove restrictions in the Remuneration and Allowances Act 1990 on parliamentarians salary sacrificing to self managed superannuation funds. 1
