Repatriation of Defence Data Bill 2021 OUTLINE A Bill for an Act to require the repatriation of Defence data to sovereign Australian storage facilities, and for related purposes. If a sensitive data store is held in a high-risk storage facility, the Secretary must cause the sensitive data store to be transferred, before 25 April 2022, to a sovereign Australian storage facility. FINANCIAL IMPACT The bill will have no financial impact. NOTES ON CLAUSES NIL


STATEMENT OF COMPATIBILITY WITH HUMAN RIGHTS The statement of compatibility with human rights appears at the end of this explanatory memorandum. Repatriation of Defence Data Bill 2021 This bill is compatible with the human rights and freedoms recognised or declared in the international instruments listed in section 3 of the Human Rights (Parliamentary Scrutiny) Act 2011. Overview of the bill The Department of Defence renewed a deal with a Chinese-owned data storage company which threatens Australia's national security. The contract with Global Switch was renewed by the department. Global Switch has stored sensitive military files for the Australian Government for the past decade. This bill provides for an Act to require the repatriation of Defence data to sovereign Australian storage facilities, and for related purposes. If sensitive data store is held in a high-risk storage facility, the Secretary must cause the sensitive data store to be transferred, before 25 April 2022, to a sovereign Australian storage facility. Human rights implications This bill does not engage any of the applicable rights or freedoms. Conclusion This bill is compatible with human rights because it does not raise any human rights issues.
