             EXPLANATORY MEMORANDUM

Save Our Sharks Bill 2014

GENERAL OUTLINE: Policy Rationale

This Bill seeks to void the Ministerial exemption granted on 10 January 2014 in
relation to the shark cull in Western Australia, and will also ensure that no similar
declaration or exemption will have any effect.

NOTES ON CLAUSES

Clause 1 - Short title

This clause provides for the Bill, when enacted, to be cited as the Save Our Sharks Act
2014.

Clause 2 - Commencement

This clause provides for the Act to commence on the date of introduction, 25 March
2014.

Clause 3 - Exemptions

Subclause 3(1) provides that the Minister for the Environment must not grant an
exemption under section 158 of the Environment Protection and Biodiversity
Conservation Act 1999 in relation to drum lines deployed for the purposes of catching
sharks.

Subclause 3(2) voids the exemption granted on 10 January 2014 to set up 72 baited
drum lines.

        STATEMENT OF COMPATIBILITY WITH HUMAN RIGHTS


 Prepared in accordance with Part 3 of the Human Rights (Parliamentary Scrutiny)
                                    Act 2011


                             Save Our Sharks Bill 2014


This Bill is compatible with the human rights and freedoms recognised or declared in
the international instruments listed in section 3 of the Human Rights (Parliamentary
Scrutiny) Act 2011.


Overview of the Bill:


The purpose of this Bill is to void the Ministerial exemption granted under section
158 of the Environment Protection and Biodiversity Conservation Act 1999 in relation
to drum lines deployed to catch sharks. This Bill would also ensure that no similar
exemption is granted in the future.


Human Rights Implications:


This Bill does not engage any of the applicable rights or freedoms.


Conclusion:


This Bill is compatible with human rights as it does not raise any human rights issues.
