FISHERIES MANAGEMENT ACT 1991 - SECT 87J

Use of force to exercise powers relating to boat

Force to be used only in limited circumstances

             (1)  An officer must not use force in the exercise of the officer's powers under a provision of section 84 (as it applies of its own force or because of section 87G or 87HA) or under section 87H, unless it is necessary to do so:

                     (a)  to ensure the safety of an officer; or

                     (b)  to overcome obstruction of an officer in the exercise of that officer's powers.

Force used must be reasonable

             (2)  The force used must not be more than is reasonably required for the relevant purpose described in paragraph (1)(a) or (b).
