(a)     The Judges' Pensions Act 1968 was amended by section 3 only of the Statute Law (Miscellaneous Provisions) Act (No. 1) 1986, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act shall come into operation on the day on which it receives the Royal Assent.

(b)     The Judges' Pensions Act 1968 was amended by section 3 only of the Law and Justice Legislation Amendment Act (No. 2) 1992, subsections 2(1) and (3) of which provide as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

                 (3)   The amendments of the Family Law Act 1975 (other than the amendment inserting a new section 37C of that Act), and the amendments of the Judges (Long Leave Payments) Act 1979 and the Judges' Pensions Act 1968, made by this Act are taken to have commenced on 1 November 1991.

(c)     The Judges' Pensions Act 1968 was amended by Schedule 10 (item 1) only of the Law and Justice Legislation Amendment Act 1997, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

(d)     The Judges' Pensions Act 1968 was amended by Schedule 5 only of the Superannuation Legislation Amendment (Superannuation Contributions Tax) Act 1997, subsection 2(1) of which provides as follows:

                 (1)   Subject to subsection (2), this Act commences on the day on which it receives the Royal Assent.

(e)     The Judges' Pensions Act 1968 was amended by Schedule 9 only of the Law and Justice Legislation Amendment Act 1999, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on the day on which it receives the Royal Assent.

(f)      The Judges' Pensions Act 1968 was amended by Schedule 18 only of the Federal Magistrates (Consequential Amendments) Act 1999, subsection 2(1) of which provides as follows:

                 (1)   Subject to this section, this Act commences on the commencement of the Federal Magistrates Act 1999.

(g)     Subsection 2(1) (item 2) of the Family Law Legislation Amendment (Superannuation) (Consequential Provisions) Act 2002 provides as follows:

                 (1)   Each provision of this Act specified in column 1 of the table commences, or is taken to have commenced, on the day or at the time specified in column 2 of the table.

21  Application

The amendments made by this Schedule do not apply in respect of a Justice or Judge of a federal court appointed before the commencement of this Schedule.

Schedule 1

256  Application of amendments

(1)       The amendments made by this Schedule apply in relation to a service offence committed by a person on or after the commencement day.

(2)       The amendments made by this Schedule also apply in relation to a service offence committed by a person before the commencement day if, before the commencement day, the person had not been charged with the offence under the old DFDA.

 

Judges' Pensions Amendment Act 2007 (No. 162, 2007)

Schedule 1

15  Application--item 1

The amendment made by item 1 of this Schedule applies to define the salary of a Judge, whether he or she retires before, on or after the commencement of that item.

16  Application--items 2 to 7

            The amendments made by items 2 to 7 of this Schedule (inclusive) apply in relation to the annual rate of pension for a Judge, whether he or she retires before, on or after the commencement of those items.

17  Application--items 8 to 12

The amendments made by items 8 to 12 of this Schedule (inclusive) apply in relation to a Judge who retires or, for the purposes of working out the rate of relevant pension, is taken to have retired, on or after the commencement of those items.

18  Application--item 14

The amendment made by item 14 of this Schedule applies in relation to amounts that become payable on or after the commencement of that item.

19  Transitional

(1)       This item applies if this Act receives the Royal Assent after 1 July 2007.

(2)       If:

                     (a)  a person is entitled to make an election within a period of 2 months falling immediately after a particular event under:

                              (i)  subsection 6C(2); or

                             (ii)  paragraph 7(2)(b); or

                            (iii)  paragraph 9(3)(b); or

                            (iv)  paragraph 11(2A)(b); or

                             (v)  paragraph 12(2A)(b);

                            of the Judges' Pensions Act 1968, as amended by items 8 to 12 of this Schedule; and

                     (b)  the event occurs on or after 1 July 2007 but before the day on which the Act receives the Royal Assent;

the person may instead make the election within the period of 2 months falling immediately after the day on which this Act receives the Royal Assent.

 

Same-Sex Relationships (Equal Treatment in Commonwealth Laws--Superannuation) Act 2008 (No. 134, 2008)

4  Entitlements from 1 July 2008

             (1)  If:

                     (a)  a person would have been entitled to one or more payments (the lost payments) under an Act that is amended by Schedule 1, 2, 3 or 5 to this Act if the relevant Schedule had commenced on 1 July 2008; and

                     (b)  because the Schedule did not commence until after 1 July 2008, the person is not entitled to the payment or payments; and

                     (c)  the person makes an application to the Finance Minister for one or more payments (the replacement payments) to compensate the person for the lost payments;

the Finance Minister must make a determination, in accordance with subsection (4), to fully compensate the person.

             (2)  If:

                     (a)  a person would have been entitled to one or more payments (the lost payments) under the Military Superannuation and Benefits Act 1991 if the first amendment of the Trust Deed under that Act that is made after the commencement of this section had commenced on 1 July 2008; and

                     (b)  because that amendment did not commence until after 1 July 2008, the person is not entitled to the payment or payments; and

                     (c)  the person makes an application to the Finance Minister for one or more payments (the replacement payments) to compensate the person for the lost payments;

the Finance Minister must make a determination, in accordance with subsection (4), to fully compensate the person.

             (3)  If:

                     (a)  a person would have been entitled to one or more payments (the lost payments) under the Superannuation Act 1990 if the first amendment of the Trust Deed under that Act that is made after the commencement of this section had commenced on 1 July 2008; and

                     (b)  because that amendment did not commence until after 1 July 2008, the person is not entitled to the payment or payments; and

                     (c)  the person makes an application to the Finance Minister for one or more payments (the replacement payments) to compensate the person for the lost payments;

the Finance Minister must make a determination, in accordance with subsection (4), to fully compensate the person.

             (4)  A determination by the Finance Minister under this subsection must:

                     (a)  be in writing; and

                     (b)  set out:

                              (i)  the amount and timing of the replacement payments; or

                             (ii)  the method of determining the amount and timing of the replacement payments.

             (5)  An application must be in writing in the form approved by the Finance Minister.

             (6)  To avoid doubt, a determination of the Finance Minister that a person is entitled to one or more replacement payments does not affect the entitlements of any other person under an Act amended by Schedule 1, 2, 3 or 5 to this Act, the Military Superannuation and Benefits Act 1991 or the Superannuation Act 1990.

             (7)  Replacement payments are to be made out of the Consolidated Revenue Fund, which is appropriated accordingly.

             (8)  A determination made under this section is not a legislative instrument.

             (9)  In this section:

Finance Minister means the Minister who administers the Financial Management and Accountability Act 1997.

Schedule 2

26  Application of amendments of the Judges' Pensions Act 1968

(1)       The amendments of the Judges' Pensions Act 1968 made by this Schedule apply in relation to any pension payable under that Act in respect of a person who dies on or after the commencement of this Schedule if, at the time of his or her death, the deceased person was a Judge or a retired Judge.

(2)       The amendments of the Judges' Pensions Act 1968 made by this Schedule apply in relation to any pension payable under the Building and Construction Industry Improvement Act 2005 in respect of a person who dies on or after the commencement of this Schedule if, at the time of his or her death, the deceased person was or had been the ABC Commissioner.

10  Saving--appointments

The amendments made by Schedule 2 do not affect the validity of an appointment that was made under an Act before the commencement of this item and that was in force immediately before that commencement.

11  Transitional regulations

The Governor-General may make regulations prescribing matters of a transitional nature (including prescribing any saving or application provisions) relating to the amendments and repeals made by Schedules 1 and 2.
