Commonwealth Consolidated Acts(1) Subject to subsection (2) and to any condition of a licence relating to the variation of the licence, the Minister may, in the Minister's discretion, upon application being made in accordance with the appropriate form by the holder of a licence granted under section 19 in respect of a boat, vary the licence by omitting the name of the boat and substituting the name of another boat.
(2) Where:
(a) a fee is payable under this Act in respect of the variation under subsection (1) of a licence granted under section 19; or
(b) levy is payable under the Fisheries Levy Act 1984 on the variation under subsection (1) of this section of a licence granted under subsection 19(2) or (3);
the Minister shall not vary the licence unless the holder of the licence tenders the amount of the fee or levy, as the case may be.
