NAVIGATION (CONSTRUCTION) REGULATIONS 1968 - REG 21
Exemption
The Authority may, by instrument in writing, grant in relation to a ship
(other than a nuclear ship), subject to such conditions, if any, as it thinks
necessary, an exemption from compliance with a requirement of this Division,
if, in its opinion:
- (a)
- the intact metacentric height of the ship in any
service condition necessary to meet the requirements of this Division is
excessive for the service for which the ship is intended;
- (b)
- the
proportions, arrangements and other characteristics of the ship are the most
favourable to stability after damage that can practically and reasonably be
adopted in the particular circumstances; and
- (c)
- in all the circumstances it
would be unreasonable to require compliance with the requirement.
