Commonwealth Consolidated Regulations Commonwealth Consolidated Regulations(1) For the purposes of section 25 of the Act, the prescribed period is the period that commences on the priority date of the claim of the specification of the main invention and ends immediately before the priority date of the relevant claim of the specification of the patent of addition.
(2) In subregulation (1), a reference to the claim of the specification of the main invention is a reference to:
(a) the claim defining that main invention; or
(b) if there are 2 or more claims defining the main invention --
the claim that has the earlier or earliest priority date.
