1980 No. 386 BANKRUPTCY RULES (AMENDMENTS) - REG 9

9. Rule 18 of the Bankruptcy Rules is amended-

   (a)  by omitting sub-rule (1) and substituting the following sub-rule:

"(1) Where the Court-

   (a)  has given a direction under sub-section 50 (1) of the Act; or

   (b)  having given a direction under sub-section 50 (1) of the Act, has
        issued a summons under sub-section 50 (2) of the Act,
and the amount deposited with the Official Trustee in accordance with the
direction of the Court is insufficient to meet the fees and expenses incurred
by the Official Trustee-

   (c)  as a result of the direction; or

   (d)  in carrying out an examination of a person as a result of the issue of
        the summons,
the Official Trustee may apply to the Court for an order directing the
creditor by whom the application under sub-section 50 (1) of the Act was made
to deposit with the Official Trustee such additional sum as the Court
directs.";

   (b)  by omitting from sub-rule (2) "the official receiver" (wherever
        occurring) and substituting "the Official Trustee"; and

   (c)  by omitting from sub-rule (2) "in taking control of the property of
        the debtor" and substituting "incurred as a result of the direction,
        or in carrying out an examination of a person as the result of the
        issue of a summons, or both, as the case requires,".
