Schedule 1 (Specified expressions in relation to transmitters) 1991 No. 360 RADIOCOMMUNICATIONS (LICENSING AND GENERAL) REGULATIONS (AMENDMENT) - REG 1 1. Amendment 1.1 The Radiocommunications (Licensing and General) Regulations are amended as set out in these Regulations. (NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48) 1991 No. 360 RADIOCOMMUNICATIONS (LICENSING AND GENERAL) REGULATIONS (AMENDMENT) - REG 2 2. Regulation 5B (Prescribed period for transmitter licences) 2.1 Omit the regulation, substitute: "5B. (1) For the purposes of paragraph 24 (5) (b) of the Act, the periods prescribed for transmitter licences are: (a) for a licence mentioned in subregulation (2) that is granted before 1 July 1996-the period beginning when these regulations commence and ending at the end of 30 June 1997; and (b) for an earth station licence mentioned in subregulation (3) that is granted before 1 July 1996-the period beginning when these regulations commence and ending at the end of 30 June 1997; and (c) for any other transmitter licence-2 years.". "(2) Paragraph (1) (a) applies to the following transmitter licences: (a) a public mobile telecommunications service, Class A licence; (b) a public mobile telecommunications service, Class B licence; (c) an AUSSAT service licence. "(3) If a person holds a licence under section 57 of the Telecommunications Act 1991, paragraph (1) (a) applies to the following earth station transmitter licences: (a) an earth station, Australian satellite service, Class A licence; (b) an earth station, Australian satellite service, Class B licence; (c) an earth station Class A licence; (d) an earth station Class B licence; (e) an earth station Class C licence; (f) an earth station Class D licence; (g) an earth station Class E licence. "(4) In subregulation (3), "earth station transmitter licence" means an earth station transmitter licence granted to the person for the purposes of providing services under the licence granted under the Telecommunications Act 1991.". 1991 No. 360 RADIOCOMMUNICATIONS (LICENSING AND GENERAL) REGULATIONS (AMENDMENT) - REG 3 3. Regulation 6 (Operation of transmitters without licence) 3.1 Paragraphs 6 (a) - (c) (inclusive): Add at the end: "and". 3.2 Regulation 6 Add at the end: "; and (e) the class of transmitters comprising mobile transmitters that: (i) are operated solely for the purpose of communicating with a base station that forms part of a service operated under a public mobile telecommunications service, Class A licence or a public mobile telecommunications service, Class B licence; and (ii) comply with AUSTEL standard TS 005 or TS 018 as in force on 26 November 1991.". 1991 No. 360 RADIOCOMMUNICATIONS (LICENSING AND GENERAL) REGULATIONS (AMENDMENT) - REG 4 4. Schedule 1 (Specified expressions in relation to transmitters) 4.1 Insert after item 71: "71A Public mobile A service consisting of two or more base telecommunications stations operated: service, Class A a) for the purposes of providing public mobile telecommunications services; and (b) by a person who holds a public mobile licence under section 57 of the Telecommunications Act 1991; and (c) on a frequency or frequencies in the range 870 MHz to 890 MHz.
