1.Amendment


  1.1 The Telecommunications (Carrier Licence Fees) Regulations are amended as
set out in these Regulations.
(NOTE: These Rules commence on gazettal: see Acts Interpretation Act 1901,
s.48.)

2. Regulation 2 (Interpretation)


  2.1 Definition of "carrier's traffic share":
Omit the definition, substitute:
  "'carrier's traffic share', in relation to a particular carrier, means the
figure worked out using the formula:
               particular carrier's timed traffic
                  all carriers' timed traffic;".
  2.2   Insert the following definitions:
  "'predecessor', in relation to a carrier, means a body to which the carrier
is, under paragraph 11 (c) of the Australian and Overseas Telecommunications
Corporation Act 1991, in law a successor;
  'timed connection' has the meaning given by subsections 305 (2), (3) and (4)
of the Telecommunications Act 1991.".
  2.3   Definition of "timed traffic":
Omit the definition.
2.4   Add at the end:
  "(2) For the purposes of the formula in the definition of 'carrier's traffic
share':
  (a) 'particular carrier's timed traffic' means, in relation to a particular
carrier, the total (expressed in minutes) of the respective durations of all
timed connections established during a relevant financial year across
telecommunications networks in Australia operated by:
    (i) the particular carrier; or
    (ii) the particular carrier's predecessor;
  (b) 'all carriers' timed traffic' means the total (expressed in minutes) of
the respective durations of all timed connections established during that
financial year across telecommunications networks in Australia operated by:
    (i) any carrier (including the particular carrier); or
    (ii) the predecessor of a carrier referred to in subparagraph
        (i).".

3.   Regulation 3 (Amount of licence fee)


  3.1   Paragraph 3 (1) (a):
Omit "moneys", substitute "money".
