Agricultural and Veterinary Chemicals Regulations 1999
Section 18 and section 25 of the Agricultural and Veterinary Chemicals Act 1994 (the Act) provide for prescribed functions and powers to be conferred on officers and authorities of the Commonwealth.
The Agricultural and Veterinary Chemicals Bill was passed in 1994 as part of the package of legislation to implement the National Registration Scheme for agricultural and veterinary chemicals. The Agricultural and Veterinary Chemicals Regulations ("the Regulations") provide necessary support to the Act.
The proposed regulations allow the National Registration Authority for Agricultural and Veterinary Chemicals (NRA) to use the Commonwealth Director of Public Prosecutions (DPP) for prosecutions in connection with the operations of the NRA. The proposed regulation has the support of all State and Territory governments.
Details of the regulations are as set out below.
Regulation 1 names the Regulations as the Agricultural and Veterinary Chemicals Regulations 1999.
Regulation 2 specifies that the Regulations will commence on gazettal.
Regulation 3 specifies that the term 'Act' refers to the Agricultural and Veterinary Chemicals Act 1994.
Regulation 4 prescribes with precision the functions the Commonwealth Director of Public Prosecutions can undertake for the NRA.
