Veterans' Entitlements Regulations (Amendment)

The Governor-General may make regulations under section 216 of the Veterans' Entitlements Act 1986 (the Act) for the purposes of the Act
Section 102 of the Act provides for the 9 rant of a fortnightly allowance in specified circumstances to a veteran who has been awarded an eligible decoration for gallantry during a war to which the Act applies or during warlike operations.
A list of eligible decorations is included in subsection 102(5) with paragraph (d) providing for other decorations to be prescribed. To date no decorations have been prescribed.
A recent application for decoration allowance has highlighted a case of the British Empire Medal being awarded for gallantry arising from action in war or warlike operations. The British Empire Medal is not listed in the eligible decorations in subsection 102(5) of the Act.
New regulation 6A prescribes the British Empire Medal as an eligible decoration for the purposes of granting decoration allowance under the Act.
