The Legislature of New South Wales enacts: 1
1 Name of Act 2
This Act is the Prevention of Cruelty to Animals Amendment Act 2009. 3
2 Commencement 4
This Act commences on the date of assent to this Act. 5

Omit the section. Insert instead: 4
24N Notices in relation to animals 5
(1) If an inspector is satisfied on reasonable grounds that a person is 6
contravening a provision of this Act or the regulations in relation 7
to an animal, the inspector may give the person a notice in writing 8
requiring the person to take such specified action in relation to the 9
animal as the inspector considers necessary to avoid any further 10
contravention. 11
(2) A person who, without reasonable excuse, fails to comply with a 12
notice is guilty of an offence. 13
Maximum penalty: 25 penalty units. 14
(3) A person cannot be convicted for both an offence against this 15
section and another offence under this Act or the regulations in 16
respect of the same act or omission. 17

Omit section 35 (3). Insert instead: 19
(3) A regulation may create an offence punishable by a penalty not 20
exceeding the relevant maximum amount, being: 21
(a) in the case of an offence relating to animal trades or the 22
confinement or use of laying fowl (domesticated chickens) 23
for commercial egg production--200 penalty units for an 24
offence committed by a corporation and 50 penalty units 25
for an offence committed by an individual, or 26
(b) in any other case--25 penalty units. 27
