New South Wales Technical and Further Education Commission Amendment (TAFE Funding Guarantee) Bill 2016 Explanatory note This explanatory note relates to this Bill as introduced into Parliament. Overview of Bill The object of this Bill is to amend the Technical and Further Education Commission Act 1990 to ensure that not less than 70% of funding for vocational education and training is allocated to the TAFE Commission. Outline of provisions Clause 1 sets out the name (also called the short title) of the proposed Act. Clause 2 provides for the commencement of the proposed Act on the date of assent to the proposed Act. Technical and Further Education Commission Amendment (TAFE Funding Guarantee) Bill 2016 [NSW] The Legislature of New South Wales enacts: 1 1 Name of Act 2 This Act is the Technical and Further Education Commission Amendment (TAFE 3 Funding Guarantee) Act 2016. 4 2 Commencement 5 This Act commences on the date of assent to this Act. 6 3 Amendment of Technical and Further Education Commission Act 1990 No 118 7 Section 3A 8 Insert after section 3: 9 3A TAFE funding guarantee 10 (1) It is the intention of Parliament that not less than 70% of funding for 11 vocational education and training is allocated to the TAFE Commission. 12 For the purposes of this subsection, funding for vocational education 13 and training includes any money that is allocated for vocational 14 education and training through any competitive or other market process, 15 but does not include any fees or commercial income from the provision 16 of vocational education and training. 17 (2) In addition to subsection (1), it is the intention of Parliament that the 18 TAFE Commission receives, in each of its regions, not less than 70% of 19 the funding allocated to public and private providers of vocational 20 education and training courses in that region. 21 Page 2
