Application of funds in absence of authority
52 Application of funds in absence of authority
(1) If an authority held by a person or organisation has been cancelled or if
the Secretary is satisfied a person or organisation is conducting or has
conducted a fundraising appeal without lawful authority or contrary to the
person's or organisation's authority, the Secretary may apply to the Supreme
Court for an order for the disposition of assets of the person or organisation
that the Supreme Court is satisfied are, or are traceable to, the proceeds of
a fundraising appeal conducted by the person or organisation.
(2) More than
one application may be made in respect of the same person or organisation.
(3) Having regard to the purposes or objects of a fundraising appeal to which
the assets are referable, the Supreme Court may make an order for the
disposition of the assets as it thinks fit.
(4) The Supreme Court may also
make any consequential or ancillary orders as it thinks fit.
