GENE TECHNOLOGY (GM CROP MORATORIUM) ACT 2003 - SECT 29
Search warrants
29 Search warrants
(1) An inspector may apply to an authorised officer for a search warrant for
premises if the inspector believes on reasonable grounds: (a) that a provision
of this Act or the regulations is being or has been contravened on the
premises, or
(b) that there is on the premises evidence of a contravention of
a provision of this Act or the regulations.
(2) An authorised officer to whom
such an application is made may, if satisfied that there are reasonable
grounds for doing so, issue a search warrant authorising an inspector named in
the warrant: (a) to enter and inspect any premises, and
(b) to exercise the
powers, or any specified powers, of an inspector under this Part.
(3)
Division 4 of Part 5 of the Law Enforcement
(Powers and Responsibilities) Act 2002 applies to a search warrant issued
under this section.
(4) In this section:
"authorised officer" has the same meaning as it has in the Law Enforcement
(Powers and Responsibilities) Act 2002 .
