Application requirements
105E Application requirements
(1) An application for a licence is to be made in the manner and accompanied
by the documents (if any) determined by the Authority.
(2) An application for
a joint licence may be made by 2 or more persons.
(3) Without affecting the
generality of subsection (1), an applicant for a licence may be required to
furnish the following particulars and documents-- (a) particulars of the
shareholders, directors and other managers of the applicant,
(b) previous
returns and accounts under the Corporations Law , the Corporations Act 2001
of the Commonwealth and the Insurance Act 1973 of the Commonwealth,
(c)
particulars of re-insurance arrangements to which the applicant is a party,
(d) a draft business plan under section 105S.
(4) In addition to the matter
specified in subsection (3), an applicant for a licence as a licensed provider
to provide cover under a fidelity fund scheme must furnish the following-- (a)
particulars of all of the trustees of the fund,
(b) a copy of the trust deed
for the fund certified in accordance with the requirements of the regulations
(if any),
(c) particulars of any insurance arrangements to underwrite the
liabilities of the Fund.
(5) A person who, in or in connection with an
application for a licence, makes a statement knowing that it is false or
misleading in a material particular is guilty of an offence. : Maximum
penalty--500 penalty units or imprisonment for 2 years, or both.
