Continuing offences
139A Continuing offences
(1) This section applies to a provision of this Act or the regulations
requiring a person to do, or stop doing, something (a
"continuing requirement provision" ) regardless of whether-- (a) the
requirement is imposed by a notice or in another way, or
(b) the person is
required to do, or stop doing, something within a specified period.
(2) A
person who is guilty of an offence because the person contravenes a
continuing requirement provision-- (a) continues, until the requirement is
complied with and despite the fact a specified period has expired or time has
passed, to be liable to comply with the requirement, and
(b) is guilty of a
continuing offence for each day the contravention continues.
(3) This section
does not apply to an offence if the relevant provision of this Act or the
regulations does not provide for a penalty for a continuing offence.
(4) This
section does not apply to the extent a requirement imposed on a person is
revoked.
